This regulation organizes and controls tax exemptions in Honduras to rationalize public spending. It establishes which taxes are eliminated, which are maintained with specific exceptions, and regulates new tax rates on income, sales, and special contributions to ensure the State collects revenue fairly based on the economic capacity of taxpayers and businesses.

Considerations

Whereas, in accordance with Article 351 of the Constitution of the Republic, the National Tax System shall be governed by the principles of legality, proportionality, generality, and equity, in accordance with the taxpayer's economic capacity.

Whereas, on December 30, 2013, Decree No. 278-2013 containing the Law on the Organization of Public Finances, Control of Exemptions, and Anti-Evasion Measures was published in the Official Gazette "La Gaceta," in force as of January 1, 2014, which has the purpose of rationalizing and controlling tax exemptions, as well as implementing anti-evasion measures and public spending controls.

Whereas, on April 5, 2014, Decree No. 290-2013 containing reforms and interpretations of Decree No. 278-2013 was published in the Official Gazette "La Gaceta."

Whereas, through Decree No. 2-2014 published in the Official Gazette "La Gaceta" on February 5, 2014, Article 17 of Decree No. 278-2013 was repealed, containing the reform of Article 15, subsections a) and e) of the Sales Tax Law and its reforms, and through Decree No. 4-2014 published in the Official Gazette "La Gaceta" on March 6, 2014, Executive Agreement No. 005-2014 was approved, published in the Official Gazette "La Gaceta" on February 8, 2014, which contains the list of essential articles of popular consumption selected from the Sales Tax.

Whereas, Article 50 of Decree No. 278-2013 containing the Law on the Organization of Public Finances, Control of Exemptions, and Anti-Evasion Measures, dated December 21, 2013, orders the regulation of the aforementioned Law in order to facilitate its implementation.

Whereas, the present Regulation has been elaborated jointly by the State Secretariat of Finance and the Executive Directorate of Revenue (DEI), with the purpose of introducing procedural rules for the correct implementation of the Law.

Whereas, it corresponds to the Executive Branch to issue regulations of the Public Administration, in application of Article 41 of the Administrative Procedure Law and its reforms.

Whereas, in accordance with the Constitution of the Republic and international treaties, the human person is the supreme purpose of society and the State, for which reason it must provide mechanisms for the person to develop fully in a peaceful and orderly social group, based on respect for legal norms and the rights of others. In this sense, the Government of Honduras has made a series of important efforts in the fight against organized crime, a phenomenon that disrupts social order and also prevents the full development of the State in all aspects that it encompasses.

Whereas, the various efforts to combat ORGANIZED CRIME, DRUG TRAFFICKING, AND MONEY LAUNDERING must not only be directed at achieving the deprivation of liberty of the perpetrators or participants in criminal acts, but new legal instruments have also been developed for the purpose of identifying, locating, and recovering illicitly acquired assets, through the figure of seizure or confiscation of property, an accessory penalty or judicial sanction that seeks to deter criminal activity through a penalty of real or patrimonial character that may be applied regardless of the criminal responsibility for the unlawful act, in addition to striking at the financial structure of criminal organizations so that they cannot continue financing their illegal activities and others related to them.
