This law strengthens the fight against money laundering and organized crime by creating the Seized Assets Management Office (OABI) to guard and manage confiscated money and property. It establishes quick procedures to freeze suspicious assets, sell deteriorating goods, and distribute confiscated funds among security and prevention institutions. It also allows for restitution of assets to victims of kidnapping, extortion, and corruption.

Considerations

Whereas, in accordance with the Constitution of the Republic and international treaties, the human person is the supreme purpose of society and of the State, which is why it must seek mechanisms for its full development in a peaceful and orderly social group, based on respect for legal norms and the rights of others. In this sense, the Government of Honduras has made a series of important efforts in the fight against organized crime, a phenomenon that disrupts social order and furthermore prevents the full development of the State in all aspects it encompasses.

Whereas the various efforts to combat ORGANIZED CRIME, DRUG TRAFFICKING AND MONEY LAUNDERING must not only be directed at achieving the deprivation of liberty of the authors or participants in public offenses, but new legal instruments have also been developed in order to identify, locate and recover assets illicitly acquired through the figure of seizure or confiscation of assets, an accessory penalty or judicial sanction that aims to discourage criminal activity through a sanction of a real or patrimonial nature that may be applied regardless of the criminal responsibility of the illicit act, in addition to striking at the financial structure of criminal organizations so that they cannot continue financing their illegal activities and others related to them.

Whereas in order to achieve an effective comprehensive fight against the commission of the different criminal offenses that result in the legitimation of economic gains generated by organized crime and that in turn affect our society, countries must consider the creation of interinstitutional bodies or commissions that promote the coordination and cooperation of the different national and international actors related directly or indirectly to the Prevention and Combat of Organized Crime.

Whereas it is imperative to update the legislation in this matter, so that it is harmonized and in accordance with these aspirations, in order to clearly indicate the legal and social obligations that must be fulfilled by Justice Operators, thereby achieving a correct, transparent, effective and efficient prevention and combat against the phenomenon of organized crime and its consequences.

Whereas illicit activities such as: kidnapping, extortion and corruption cause serious harm to society, undermine public institutions, the values of democracy, ethics and justice, threatening the political stability and sustainable development of societies.

Whereas the victim is the natural or legal person who suffers physical, moral, psychological, patrimonial or material damage caused by a crime and has the right to be compensated for the damages caused and when it is not possible to reverse the damage, it must be replaced by compensation of a pecuniary nature.

Whereas the Republic of Honduras is a party to the United Nations Convention against Corruption, in which the States Parties undertake to promote and strengthen measures to prevent and combat corruption more effectively and efficiently, as well as to promote, facilitate and support international cooperation and technical assistance in the prevention and fight against corruption, including the recovery of assets.

Whereas it is the responsibility of the Office for the Administration of Seized Assets (OABI) to distribute cash money plus its returns, profits or interest that are at its disposal by having been seized.

Whereas in accordance with Article 205, attribution 1) of Decree 131 dated January 11, 1982, of the Constituent National Assembly which contains the Constitution of the Republic, it is an attribution of the National Congress to create, decree, interpret, reform and repeal laws.
