- Decree: 6-2017
- Published: February 27, 2017
- Issuing body: Congreso Nacional
- Gazette: 34,276
- Category: Criminal
Summary
This law reforms the Honduran Penal Code to strengthen penalties against extortion (now 15 to 20 years imprisonment) and creates new terrorism crimes, especially when criminal groups exercise territorial control and terrorize populations. It also establishes the National Penitentiary Institute with new administrative structures, improves the prison system with emphasis on rehabilitation, and introduces benefits such as pre-release and conditional release for social reintegration.
Considerations
Whereas pursuant to Article 59 of the Constitution of the Republic, "the human person is the supreme end of society and the State. Everyone has the obligation to respect and protect it".
Whereas in accordance with the provisions of Article 61 of the Constitution of the Republic, it guarantees to Hondurans and foreign residents in the country, the right to the inviolability of life, individual security, freedom, equality before the law, and property.
Whereas the crime of extortion, provided for in Article 222 of the Penal Code, currently has an insufficient legal configuration that does not correspond to reality, since the same, due to its multi-offensive nature, not only injures or endangers the patrimony of an individual and even when an actual detriment does not occur, such actions have already affected other individual legal rights such as personal autonomy.
Whereas the principal reasons for the existence of the State are to protect the lives of persons, as well as their physical and moral integrity, and their property, by establishing legal frameworks that ensure its population well-being and prosperity in an environment of trust, security, and guarantee of the rights established in the Constitution of the Republic, International Conventions, and other Laws.
Whereas recently in our country groups of illicit association, identified as "maras" or "gangs" have executed various actions that gravely violate the human rights of populations residing in specific areas of the country in which these groups exercise control, where circulation is only permitted with their authorization and they even evict from their homes or neighborhoods those who do not submit to their control, increasing the number of violent deaths, the forced displacement of hundreds of families that are extorted or threatened, causing serious intimidation and fear.
Whereas currently groups of illicit association have evolved their modus operandi in such a way that their criminal activity is not only directed at producing specific harm against their victims, but they use this harm or threat as a means to cause intimidation and terror in the population, with the objective of coercing society or the State to do or refrain from doing something.
Whereas in accordance with Article 87 of the Constitution of the Republic, penal institutions are establishments of security and social defense, in which the rehabilitation of persons deprived of liberty and their preparation for work shall be pursued.
Whereas penal facilities constitute an essential component of the Criminal Justice System of the country to guarantee the security of the inhabitants of the Republic.
Whereas in accordance with Article 205 Attribution 1) of the Constitution of the Republic it is the power of the National Congress to: create, decree, interpret, reform, and repeal laws.
