Summary
This law reorganizes Honduras' public finances by eliminating most tax exemptions (except constitutional and international ones) and increases taxes like VAT to 15% while creating new taxes on property value increases. It benefits the State by increasing revenue to fund social programs and reduce the fiscal deficit, while affecting companies and sectors that previously enjoyed tax privileges.
Considerations
Whereas in accordance with Article 351 of the Constitution of the Republic, the National Tax System shall be governed by the principles of legality, proportionality, and equity, in accordance with the economic capacity of the taxpayer.
Whereas it is necessary to regulate the exemptions granted in the Income Tax (ISR), in the Sales Tax (ISV), and in the Tariff Rights on Imports (DAI), with the purpose of generating greater efficiency in the economy.
Whereas the different sectors of society that have enjoyed tax benefits for more than half a century must contribute to the welfare of the poorest sectors of the population, in order to build a more just and equitable society.
Whereas the control of exemptions and customs privileges is of national priority, as well as establishing anti-evasion measures in order to ensure the correct application of current legislation regarding the importation of goods.
Whereas it is of national interest to reorganize the finances of the State with the purpose of reducing the fiscal deficit, and avoiding the negative effects that it produces in the Honduran economy, both in the generation of employment and in the deterioration of the purchasing power of the Lempira. Likewise, it is appropriate to seek better collection and administration of the State's fiscal resources.
Whereas the State of Honduras is respectful of International Law, promoting State-to-State relations and relations among citizens both in the field of interpersonal relations and commerce.
Whereas the Embassy of Australia in Mexico and accredited before our country requested the State of Honduras through the Ministry of State for Foreign Relations the approval of the nomination of Mr. Miguel Antonio Nasser of Honduran nationality, as Honorary Consul of that country in Honduras.
Whereas in accordance with Attribution 17 of Article 205 of the Constitution of the Republic, it is incumbent upon the National Congress to grant or deny permission to Hondurans to accept positions or decorations from another State.
