- Decree: 194-2002
- Published: December 29, 2001
- Issuing body: Congreso Nacional
- Category: Financial & Tax
Summary
This law seeks to balance State finances and protect the population through tax changes. It increases taxes on alcoholic beverages and cigarettes from 12% to 15%, allows small businesses (up to L. 180,000 annually) to pay simplified taxes, offers facilities for taxpayers to regularize arrears without penalties, reduces vehicle and income taxes, and promotes tourism with tax exemptions for hotel investments.
Considerations
Whereas the Constitution of the Republic in its Article 328 mandates that the Economic System of Honduras is founded on principles of efficiency in production and social justice in the distribution of wealth and national income, as well as in the harmonious coexistence of the factors of production that make possible the dignification of work as the principal source of wealth and as a means of realization of the human person.
Whereas in the context of Central American integration, the countries in the region are immersed in a gradual process of tax harmonization, which implies a tariff reduction, as well as a restructuring of internal taxation, in order to promote economic development and facilitate trade operations by promoting competitiveness and exportable supply.
Whereas it is convenient to the interests of the State to make all efforts to recover to a greater extent tax debts and to facilitate taxpayers or responsible parties in fulfilling their obligations, in order to settle and regularize their situation with the Treasury.
Whereas it is necessary to introduce modifications in some internal taxes, in order to eliminate double taxation, expand tax bases, clarify technical concepts, and exercise greater control in the granting of exemptions.
Whereas the General Budget of Income and Expenses of the Republic for the Fiscal Year 2002, approved by Decree No. 237-2001 of December 29, 2001, reflects an imbalance that has a negative impact on the economy, caused by an insufficiency of resources to finance public spending, which has been increased as a result of the execution of works and projects in national reconstruction, social demands from organized groups, including salaries and resources allocated to the financial sector.
Whereas the State in granting licenses, documentation, and conducting registrations in general that guarantee the exercise of their rights to the holders, incurs substantial sums of money, which have been increasing progressively, making it necessary to reduce these administrative costs by compensating for them through the updating of their fees.

The same procedure of the preceding paragraph shall apply to the twelve percent (12%) that falls on carbonated beverages. In the case of cigarettes and other products made of tobacco, it shall be calculated based on the sale price at the wholesale stage, deducting the value of the sales tax and the production and consumption tax both in imports and in national production. For the application of the taxable base in beer, spirits, compound liquors and other alcoholic beverages, cigarettes and other products derived from tobacco and carbonated beverages, special regulations shall be issued.
