Law on Tourism Incentives
Congreso Nacional
- Decree: 314-98
- Published: December 29, 1998
- Issuing body: Congreso Nacional
- Category: Financial & Tax
Summary
This law grants tax exemptions to new and existing tourism businesses to stimulate investment in hotels, restaurants, transportation, and other tourism services. It benefits national and foreign investors with 10 years of income tax exemption for new projects and customs duties exemption on imports, aimed at generating jobs, foreign currency, and economic recovery for the country.
Considerations
Whereas the destructive force with which Hurricane and Tropical Storm Mitch attacked the country has resulted in grave damage to the economic base of the nation, particularly in sectors, such as agriculture, which will require a long recovery cycle.
Whereas strategic actions are required that make viable the economic recovery of the country and alleviate the urgent need to obtain foreign currency necessary to finance the work demanded by the recovery process.
Whereas within the spectrum of productive sectors, the tourism activity is in conditions of immediate operability, having preserved ninety-two percent (92%) of its infrastructure and ninety percent (90%) of the supply of natural and cultural tourist attractions of the country.
Whereas to stimulate a greater influx of international visitors and therefore a greater capture of tourism spending in hard currency, greater investment is required in the construction of hotel infrastructure and complementary tourism services.
Whereas with a view to permitting a more equitable participation of tourism-receiving communities, it is necessary to create financing mechanisms that allow the development of tourism enterprises and activities at the national level.
Whereas in addition to efforts aimed at stimulating the growth of tourism demand, the development of competitive services must be planned to allow the mobilization of traveler flows toward national destinations.
