Summary
This law creates the Superintendence for Trustworthiness Evaluation Tests, an agency that evaluates the reliability of public servants in the Police, Public Ministry, Judiciary, and Armed Forces. Through psychological, toxicological, and other evaluations, it determines whether officials can remain in their positions and can order their dismissal if they fail. It aims to strengthen institutional credibility and ensure trustworthy public servants.
Considerations
Whereas the promotion and protection of the economic interests of consumers, as well as access to adequate and truthful information regarding the commercialization of goods and services, is a universal right of consumers.
Whereas it is within the power of the National Congress to create, decree, reform, interpret, and repeal laws.
Whereas through Decree No. 286-2009 dated January 13, 2010, the Law for the Establishment of a Vision for the Country and the Adoption of a Plan of the Nation for Honduras is adopted.
Whereas Article 6 of the Law referenced in the preceding recital establishes the Vision for the Country for the year 2038, which comprises the National Objectives and Goals of National Priority, and in its Objective 2, recognizes and aspires to a Honduras developing in democracy, with security and without violence, and its Goal 2.2 proposes to reduce the homicide rate per 100,000 inhabitants to a level below the international average.
Whereas in light of the situation that the country has faced in matters of security, it is noteworthy to recall the existence of consensus among actors of the political-civil society at the time of the configuration of the Law Vision for the Country and Plan of the Nation; from which it follows that taking into consideration that no change, not only of precepts but also of persons, is achieved immediately, it is necessary following this current legal framework, the adoption of complementary regulations that are consequent and effective with the expectations that the State has already set forth in this Plan of the Nation that we all wish to achieve.
Whereas principles are the firm foundation upon which every Law is sustained, and therefore the international trend in recent times reinforces the observance of the principle of good institutional image; its preservation constitutes the principal basis of the relationship of trust and legitimacy that must prevail between members of every public service and society in general.
Whereas the principle of good image of the country intrinsically entails the relationship of trust, the center of fundamental security needs are found in the fact that the capacity and morality of its operators are strongly questioned by the media and society, and that its highest authorities strive to change said image in pursuit of the respect that institutional perspectives deserve. For this reason, it is an opportunity that this Law be adapted to such a present necessity, and thus contribute to achieving the objectives that the government foresees with respect to a safer Honduras.
