This law controls and regulates the manufacturing, importation, sale, carrying, and use of firearms, ammunition, and explosives in Honduras. It establishes a registration and licensing system for authorized private individuals, limits on permitted calibers, and clear prohibitions. It aims to combat illegal arms trafficking and reduce violence by assigning responsibilities to the Armed Forces, National Police, and security authorities.

Considerations

Whereas Article 292 of the Constitution of the Republic establishes the exclusive authority of the Armed Forces for the manufacture, importation, distribution and sale of arms and ammunition. In the same sense, Article 238 of Decree No. 39-2001 dated April 16, 2001, which contains the Constitutive Law of the Armed Forces, provides that it is the exclusive authority of the Armed Forces to engage in the "manufacture, importation, distribution and sale of arms, ammunition, explosives and other similar implements".

Whereas the State of Honduras is obligated by virtue of international conventions, among which stand out the United Nations Treaty on the Trade in Arms and the Protocol Against the Illicit Manufacturing of and Trafficking in Firearms, their Parts, Components and Ammunition, to establish measures to control the manufacture, repair and illicit trafficking of arms, ammunition and explosives; the Constitution of the Republic, in a binding manner, mandates the support of the Armed Forces in the fight against terrorism and arms trafficking.

Whereas the Constitution of the Republic, in establishing the framework of declarations, guarantees, duties and rights, determines the obligation of the State to protect and preserve the right to life, health and property, as well as matters pertaining to the preservation of order and justice.

Whereas the presence of undeclared firearms and those not permitted for use by private individuals in the country is one of the most important factors contributing to violence, and it is imperative to establish control measures thereof.

Whereas the possession and use of firearms by private individuals is essentially permitted for the protection of their lives and their patrimonial property.

Whereas the Law for the Control of Firearms, Ammunition, Explosives and Other Similar Items contained in Decree No. 30-2000 dated April 11, 2000, its reforms and related provisions contained in Decrees 257-2002 dated August 6, 2002; 413-2002 dated November 13, 2002; 187-2004 dated November 25, 2004; 69-2007 dated May 31, 2007; 184-2013 dated September 1, 2013; Executive Agreement PCM-094-06 and other provisions on the matter do not respond to current needs in this field, making it necessary to issue a new legal instrument.

Whereas by virtue of Article 205, Attribution 1) of the Constitution of the Republic, it corresponds to the National Congress to create, enact, interpret, reform and repeal laws.
