Summary
This decree cancels the firearm carrying ban that had been in effect since November 2009. It allows Honduran citizens to request permits to carry firearms again, as the government determined that the reasons justifying the general disarmament had ended and it was necessary to restore this right.
Considerations
Whereas Article 245 of the Constitution of the Republic establishes that the President of the Republic is responsible for the General Administration of the State.
Whereas in accordance with Article 2 of the Firearms Control Law, Ammunition, Explosives and Similar Items contained in Decree No. 30-2000 of April 11, 2000 and published on June 29, 2000, the application thereof corresponds to the President of the Executive Branch through the Ministry of State for Security.
Whereas in accordance with Article 37 of the Public Order Law cited above, in case of alteration or disruption of public peace the authorities to whom the application of such laws corresponds shall take, within the scope of their competence, the necessary measures to ensure strict compliance therewith, including the suspension or cancellation of registered persons' permits.
Whereas by Executive Decree Number PCM-M-031-2009 dated November 19, 2009 and published on November 21 of that same year, the President of the Republic in Council of Ministers declared general disarmament, as a consequence all types of permits for carrying firearms and similar weapons were suspended, effective November 23, 2009, until further notice.
Whereas the causes that motivated the aforementioned disarmament have ceased and the right to suffrage of citizens has been thereby guaranteed and the democracy in the country has been strengthened; consequently all types of permits for carrying firearms and similar weapons must be reinstated.
