The National Civil Aviation Security School (ENSAC) is created within the National Investigation and Intelligence Directorate to train and specialize personnel in airport security, following international standards. It benefits airport workers and helps protect civil aviation against unlawful acts.

Considerations

Whereas the Constitution of the Republic in its Article 287 created the National Defense and Security Council, ordering that a Special Law shall regulate its organization and functioning.

Whereas the State of Honduras is a subscriber to the International Civil Aviation Convention (Chicago Convention) and its annexes, within which it is provided that States must implement Civil Aviation security policies, adopting normatives derived from Annex 17 and the recommended methods described in said annex.

Whereas in compliance with the order contained in the Constitution of the Republic, the National Congress issued through Decree Number 239-2011 of December 8, 2011, a Special Law that establishes the National Defense and Security Council as the highest permanent body, responsible for directing, designing and supervising general policies in matters of Security, National Defense and Intelligence.

Whereas the work of investigation and intelligence in matters of Security and National Defense is fundamental to combat impunity and therefore prevent crime, and in this regard Article 6 of the Special Law of the National Defense and Security Council creates the National Investigation and Intelligence Directorate as the executing entity of public policies that in matters of defense and security are established by the National Defense and Security Council.

Whereas through Legislative Decree 211-2012, published in the Official Gazette La Gaceta on April 15, 2013, the creation of the National Investigation and Intelligence Directorate (DNII) was established, which was created as the entity responsible for strategic investigation and intelligence activities, in order to protect the rights and freedoms of citizens and residents in the country, prevent and counteract internal or external threats against the constitutional order, through its different units.

Whereas the National Investigation and Intelligence Directorate (DNII) in the exercise of its powers through Agreement No. DNII-008-2014 dated July 11, 2014, created the Airport Security Division, being Ratified by the President of the Republic in Council of Secretaries of State through Executive Decree No. PCM-053-2014 dated August 22, 2014, in which from its effective date and for reasons of national interest and security, it assumes through the Airport Security Division (DSA), the competencies and powers that in matters of security were granted to the General Directorate of Civil Aeronautics (DGAC) now the Honduran Civil Aeronautics Agency (AHAC).

Whereas Airport Security has as its fundamental objective to safeguard persons and facilities to provide protection against acts of unlawful interference to which civil aviation may be subject; being a general duty to contribute to the competent bodies of the State making effective work in case of violation of provisions regulating air navigation, constituting it a matter of national interest the application of recommendations in airport security matters established in International Treaties and Conventions that the State of Honduras has subscribed, ratified and adhered to.

Whereas the National Intelligence Law in its article 10 establishes that for the fulfillment of its functions the National Investigation and Intelligence Directorate may create Special Units of Investigation and Intelligence for the execution of its operations.

Whereas the Law on Civil Aviation Security of Honduras in article 5 establishes as the regulatory body in matters of Airport Security of Civil Aviation the National Defense and Security Council, the National Investigation and Intelligence Directorate (DNII) and the Airport Security Division (DSA). That in article 14 of the same Law it establishes that the National Investigation and Intelligence Directorate (DNII) in matters of Civil Aviation Security is responsible for: 1)...; 2)...; 3)...; 4)...; 5) To manage the financial, material and human resources necessary to maintain active and strengthened Civil Aviation Security services, for supervision and audit of airport security operations.

Whereas in the Law on Civil Aviation Security of Honduras in article 14 it establishes that within the Powers of the National Investigation and Intelligence Directorate in addition to those contained in the Law of the National Defense and Security Council and the National Intelligence Law 1)...; 2)...; 3)...; 4)...; 5)...; 6) To approve the Organizational Structure and organization of the Airport Security Division (DSA), taking into consideration the recommendations that said Division may make in this regard.

Whereas in the Law on Civil Aviation Security of Honduras in article 16 it establishes that within the competencies of the Airport Security Division (DSA) 1)...; 2)...; 3)...; 4) To formulate and propose plans, programs and projects to its superiors that strengthen the institution, guarantee compliance with standards and develop systematically human capital in matters of competence.

Whereas in accordance with article 9 of the Regulations of the Law on Civil Aviation Security of Honduras, which establishes that; for the fulfillment of its functions the Airport Security Division shall have the Organizational, Operational and Functional structure necessary, sufficient and appropriate for the achievement of its purposes comprising at least the following structure: e) Training Department...".
