Summary
Decree 239-2011 approves reforms to the National Civil Aviation Security Program (PNSAC) to improve protection at Honduran airports. These changes allow the Airport Security Division to apply more effective rules to prevent crimes, illegal interference, and ensure safety on domestic and international flights.
Considerations
Whereas the National Congress of the Republic, within the scope of its powers, through Decree No. 239-2011 dated December 8, 2011, published in "La Gaceta", Official Gazette of the Republic on December 12 of that same month and year, approved the Special Law of the National Council for Defense and Security (CNDS), through which it grants this Council the power to design public policies in matters of security, defense, and intelligence, harmonizing actions among the different operators in this field in order to guarantee the common good. Likewise, in said legal instrument the National Directorate of Investigation and Intelligence (DNII) is established as the entity responsible for executing the public policies in matters of defense and security that the Council shall establish.
Whereas the National Directorate of Investigation and Intelligence (DNII) in the exercise of its powers, through Agreement No. DNII-008-2014 dated July 11 of that same year, created the Airport Security Division (DSA), whose mission is to carry out special operations of surveillance, control, inspection, search, and interdiction, for the purpose of identifying and combating the commission of crimes in airport activities, as well as preventing acts of unlawful interference and irregularities in the processes of national and international civil aviation in order to neutralize their effects on the security of the State and of persons within the district in accordance with the Law and Human Rights.
Whereas the State of Honduras, through the Airport Security Division (DSA), dependent on the National Directorate of Investigation and Intelligence (DNII), has among others the following objectives: to implement the National Civil Aviation Security Program (PNSAC) with the purpose of providing security, regularity, and efficiency of national and international air navigation, in a permanent and sustained manner, providing the necessary safeguards against acts of unlawful interference through regulations, recommendations, methods, and legal procedures established in both domestic and international law; likewise, to maintain the security of persons, national and foreign operators duly authorized to operate in national airspace, fundamentally at airports that provide services for both national and international flights.
Whereas the Constitutional President of the Republic through Executive Decree No. 014-2014 dated December 12, 2014, published in "La Gaceta"
Whereas it is the responsibility of the AIRPORT SECURITY DIVISION (DSA) to develop, apply, review, and keep updated the National Civil Aviation Security Program and to propose it for approval by the National Directorate of Investigation and Intelligence (DNII); and within the scope of its competencies, the DSA has proposed the reform of some concepts and provisions contained therein for better applicability and effectiveness in the functions that Division performs and other entities involved in airport security matters.
Whereas, having analyzed the arguments presented by the Chief of the Airport Security Division (DSA), it is necessary to carry out the proposed reforms in order to achieve the objectives and to be consistent with the national and international regulations established in the National Civil Aviation Security Program.
Whereas the National Directorate of Investigation and Intelligence has as its purpose to develop activities of investigation and strategic intelligence to protect the rights and freedoms of citizens and residents in the country, prevent and counteract internal or external threats against constitutional order, and execute public policies in matters of defense and security that the National Council for Defense shall establish.
Whereas the President of the Republic in Council of State Secretaries through Executive Decree No. PCM-053-2014 dated August 22, 2014, published in "La Gaceta", Official Gazette of the Republic on August 25 of that same month and year, ratified Agreement No. DNII-008-2014 issued by the National Directorate of Investigation and Intelligence (DNII) through which the Airport Security Division (DSA) was created whose mission is to carry out special operations of surveillance, control, inspection, search, and interdiction, for the purpose of identifying and combating the commission of crimes in airport activities, as well as preventing acts of unlawful interference and irregularities in the processes of national and international civil aviation in order to
