Considerations
Whereas the Constitution of the Republic establishes that: "The servants of the State have no powers other than those expressly conferred upon them by law. Any act they execute outside the law is null and implies responsibility"; "Officials are depositaries of authority, legally responsible for their official conduct, subject to the law and never superior to it." In accordance with Articles 321 and 323.
Whereas in accordance with Article 6 of the Special Law of the National Council for Defense and Security dated December 8, 2011, the National Direction of Investigation and Intelligence shall issue the statute, regulations, manuals, code of ethics and instructions that may be necessary for the application of said Law, approving them through the corresponding internal administrative act.
Whereas the National Intelligence Law establishes in its Article 11 that the Legal Representation of the National Direction of Investigation and Intelligence (DNII) corresponds to the National Director and in his absence to the Deputy National Director.
Whereas in accordance with Articles 18 and 19 of the National Intelligence Law, the National Direction of Investigation and Intelligence, without prejudice to the Law of Transparency and Access to Public Information, the activities, information and documents of Intelligence shall have the character of reserved, in view that their content is confidential or secret, as they are inherent elements to national security and defense.
Whereas the General Law of Public Administration, in its Articles 41, 42 and 43, state: "For the most efficient attention and expeditious handling of administrative matters, deconcentration is established in the manner provided by this Chapter and other applicable rules"; "Deconcentration may be functional or geographical"; "Functional deconcentration shall be verified through the creation of entities or organs which, despite depending hierarchically on a central organ, are assigned their own competence, which they exercise with technical, administrative and financial autonomy."
Whereas by means of Decree No. 211-2012, which approves the National Intelligence Law, the legal framework is established that regulates the principles, organization, coordination, control and other provisions of the National Direction of Investigation and Intelligence (DNII), which shall have as its purpose to develop investigation and intelligence activities to protect the rights and freedoms of citizens and residents in the country, prevent and counter internal or external threats against the constitutional order.
Whereas in accordance with Article 3 of the National Intelligence Law (Decree No. 211-2012), the National Direction of Investigation and Intelligence shall operate as a deconcentrated entity of the National Council for Defense and Security and shall enjoy functional, administrative and budgetary independence. The deconcentration in the manner provided by this Chapter and other applicable rules shall apply.
Whereas the acts of the organs of Public Administration shall adopt the form of Decrees, Agreements, Resolutions or Orders; in the same manner, subordinate organs, for example the National Direction of Investigation and Intelligence (DNII), may issue administrative acts in accordance with Article 116 of the General Law of Public Administration.
Whereas Article 119, final paragraph of the General Law of Public Administration establishes: "The Decrees, as well as the Agreements of the President of the Republic and the Secretaries of State, shall be published in the Official Gazette 'La Gaceta'."
Whereas by means of Agreement No. DNII-008-2014 dated July 11, 2014, the Airport Security Division (DSA) was created, being ratified by the President of the Republic in Council of Secretaries of State by Executive Decree No. PCM-053-2014 dated August 22, 2014, published in the Official Gazette La Gaceta on August 25, 2014.
Whereas Article 5 of the Law on Civil Aviation Security of Honduras states: "The regulatory entities in matters of Civil Aviation Security are: 1)…; 2)…; 3) The Airport Security Division (DSA)."; Article 6 numeral 18 "NATIONAL CIVIL AVIATION SECURITY PROGRAM (PNSAC)": It is the Civil Aviation Security document directed to the application of the standards and recommended methods of Annex Seventeen (17) "SECURITY" of the Convention on International Civil Aviation, as well as the provisions relating to Civil Aviation Security, which contains the annexes, other documents and related agreements on matters of Civil Aviation Security.
Whereas Article 14 numeral 3 of the Law on Civil Aviation Security of Honduras states: "Approve the reforms or amendments of the National Civil Aviation Security Program (PNSAC) and must inform the President of the Republic"; Article 16 numeral 5 of the Law on Civil Aviation Security states: "Prepare, implement, keep updated and review the National Civil Aviation Security Program (PNSAC) and other programs in accordance with the provisions of Annex Seventeen (17) and/or other Annexes to the Convention on International Civil Aviation."
