Summary
This law establishes a 4% tax on tourism services in Honduras that hotels, car rental companies, and inbound tourism agencies must pay. Revenue collected goes to the Honduran Tourism Institute to promote national tourism, and small establishments such as pensions and budget hostels are exempt.
Considerations
Whereas the Tourism Sector of Honduras constitutes one of the areas with significant growth in recent years, notably favoring the generation of investments, productive employment and income, having a positive impact on the economic and social development of the country.
Whereas the State of Honduras through Legislative Decree No. 131-98 of April 30, 1998 issued the Law for the Promotion of Production, Competitiveness and Support for Human Development, which in its Article 43 created the TOURISM SERVICES TAX, with the purpose of promoting and encouraging tourism activity, amended through Decree 360-2002 Article 2 dated November 25, 2002 published in the Official Journal La Gaceta on January 4, 2003.
Whereas Article 44 of Decree 131-98 establishes that the administration and control of the Tourism Services Tax shall be the responsibility of the State Secretariat of the Ministry of Finance through the Executive Direction of Revenue.
Whereas the opinion of the General Prosecutor's Office was requested, in accordance with the terms established by Article 41 of the Administrative Procedure Law, issuing a FAVORABLE opinion regarding the approval and publication of the Regulation of Articles 43 and 44 of the Law for the Promotion of Production, Competitiveness and Support for Human Development.
Whereas with respect to tourism receptive operators, the activities and services they provide are highly varied, and it is even common that the same operator sells, alternates or simultaneously provides services to domestic tourism, making it necessary to clarify and regulate the activities that must be subject to the tourism tax.
Whereas the National Congress through Legislative Decree No. 264-2010 dated December 2, 2010, approved the General Budget of Income and Expenditures of the Republic and of Decentralized Institutions for Fiscal Year 2011, as well as its General Provisions.
Whereas in the General Budget of Income and Expenditures of the Republic for Fiscal Year 2011 in Institution 120 Secretariat of Public Works, Transportation and Housing, and specifically in Program 11: Study, Design and Construction of Highways, a budget allocation is made in the amount of L.25,000,000.00 (TWENTY-FIVE MILLION LEMPIRAS EXACT) for the Reconstruction and Paving of the Highway of the South Municipal Association of the Department of Lempira.
Whereas the National Congress through Official Notice S/N dated May 12, 2011, authorizes the Secretariat of Finance to use the resources from Decree 264-2010 in favor of the General Directorate of Highways in Administrative Management 005, Implementing Unit 031, Project 011 Reconstruction and Paving of the Highway of the Municipal Association of Lempira in the amount of L.35,000,000.00 (THIRTY-FIVE MILLION LEMPIRAS EXACT), financing it with the resources allocated through Article 117 of the General Provisions of the General Budget of Income and Expenditures of the Republic, Fiscal Year 2011 and which are budgeted in the Secretariat of Finance.
Whereas Article 37 Section 2 of the Organic Law of the Budget establishes that it is the responsibility of the President of the Republic to authorize the transfer of budgetary funds between State Secretariats, Decentralized Institutions and between both.
