- Decree: 87-2019
- Published: September 23, 2019
- Issuing body: Congreso Nacional
- Gazette: 35,056
- Category: Constitutional
- Type: Other
Summary
This decree elects five magistrates to the Electoral Justice Court: four regular magistrates (Gaudy Alejandra Bustillo Martínez, Eduardo Enrique Reina García, Miriam Suyapa Barahona Rodríguez and one more) and two alternate magistrates (Francisco José Dávila Nolasco and Karen Yohana Guandique Estrada). These magistrates will lead the electoral branch of the new justice system, separate from administrative electoral functions.
Considerations
Whereas by means of Decree No. 200-2018 published in the Official Gazette "La Gaceta" on January 30, 2018, Decree No. 5-2015 of January 30, 2015 was reformed, which is substantive to the Constitution of the Republic, with the purpose of taking measures for the implementation of an electoral model.
Whereas the reform of the Constitution of the Republic represents a challenge that breaks paradigms heretofore established in Honduran culture, which brings with it the construction of a new Electoral System.
Whereas the Constitutional reform entails the separation of electoral, administrative, technical, and logistical functions on one hand, and electoral jurisdictional functions on the other, for which reason the following are created: the National Electoral Council and the Electoral Justice Court. Given that for the purpose that the National Electoral Council and the Electoral Justice Court be directed by citizens who meet the requirements of capacity and suitability, a selection process has been carried out with the representation of all political sectors.
Whereas in accordance with that established in Article 205, Attribution 11) of the Constitution of the Republic, it corresponds to the National Congress to make the election of the members of the Superior Court of Accounts, the Attorney General and Deputy Attorney General of the Republic, Councilors of the National Electoral Council, and Magistrates of the Electoral Justice Court.
