Considerations
Whereas the Constitution of the Republic establishes that the human person is the supreme end of society and the State, and all have the obligation to respect and protect it.
Whereas Article 293 of the Constitution of the Republic defines the National Police as: "A professional permanent Institution of the State, apolitical in the partisan sense, of purely civil nature, responsible for ensuring the preservation of public order, the prevention, control and fight against crime; to protect the security of persons and their property, to execute resolutions, dispositions, mandates and legal decisions of the authorities and public officials, all with strict respect for human rights. The National Police shall be governed by special legislation".
Whereas through Legislative Decree No. 68-2015 dated July 15, 2015 and published in the Official Gazette La Gaceta on October 29, 2015, the "SPECIAL LAW FOR SECURITY AND THE PREVENTION OF VIOLENCE AND INTOLERANCE IN FOOTBALL STADIUMS AND SPORTS FACILITIES" is decreed, with the purpose of preventing and eradicating violence and intolerance in sports facilities to guarantee the security of fans and the protagonists, work that is carried out by the National Police, allowing the authorities and personnel responsible for these events better organization and control.
Whereas sporting events to be held carry with them a connotation of national responsibility that transcends to the international level, therefore it is imperative to harmonize and coordinate the execution of different activities to guarantee comprehensive security that involves all active and passive actors before, during and after the event, with the purpose of ensuring the development of the sporting event.
Whereas the fundamental purpose of Legislative Decree No. 68-2015 and its Regulation is to ensure the maintenance of public order and security inside and outside football stadiums and sports facilities, work that, by excellence and in accordance with the function just expressed, corresponds to coordinate by the National Police.
Whereas the "SPECIAL LAW FOR SECURITY AND THE PREVENTION OF VIOLENCE AND INTOLERANCE IN FOOTBALL STADIUMS AND SPORTS FACILITIES", in Article 37 provides: "REGULATORY DEVELOPMENT. The Executive Power through the State Secretary in the Office of Security must issue the regulatory rules both in the specific cases provided for in this Law and in those others that are necessary for the effective application of the provisions contained therein, within a period of six (6) months from its publication in the Official Gazette 'La Gaceta'".
Whereas the content of Legislative Decree No. 68-2015 and its Regulation must be harmonious with the technical regulations relating to stadiums and professional football spectacles at the international level.
Whereas Article 36, numeral 8) of the General Law of Public Administration provides: "The attributions and duties common to the State Secretaries are to exercise superior administration and to issue Agreements and Resolutions in matters within their competence".
