This regulation creates a temporary 36-month program allowing businesses to hire workers by the hour to maintain jobs and reduce unemployment during economic crises. It establishes rights such as minimum hourly wage, 20% compensation equivalent to benefits, social security and training; and requires companies to register contracts, respect temporary hiring limits, and protect union freedom.

Considerations

Whereas, by Decree No. 230-2010 dated November 4 of that year, the Sovereign National Congress approved the National Program for Employment by Hours whose primary purpose is to establish a special emergency program of temporary character, in order to promote dignified employment, maintain job positions and prevent the growth of unemployment and underemployment rates in the country, opening work opportunities to the population during the crisis cycle that currently affects the economies of the majority of countries in the world.

Whereas, it is of paramount interest to the Nation the prompt effectiveness of said legal standard, so that the State can begin this program so that employers and workers who join it can execute their employment contracts and immediately begin their activities under this modality, complying with the standards established therein.

Whereas, it is not possible to initiate said program without having the complementary regulations to said law, such as its regulatory decree.

Whereas, in order to comply with the provisions of Article 19 of Decree 230-2010 dated November 4, 2010, which mandates that the Ministry of State in the Offices of Labor and Social Security, jointly with a member of the Labor Sector and a member of the Business Sector designated by the Economic and Social Council, shall regulate this Decree within thirty (30) days from the date of its publication in the Official Gazette La Gaceta, the respective notices were issued for this purpose through the Economic Council to the parties named, which was not answered by the Labor Sector, and having complied with the legal requirement mentioned above, the drafting of this Regulation proceeded with only the participation of the Ministry of State in the Offices of Labor and Social Security and the Business Sector for its approval by the Executive Power, being that its approval is mandatory in order to give due compliance with that mandate.

Whereas, in observance of the provisions of Article 41 of the Administrative Procedure Law, the Office of the Attorney General of the Republic issued a favorable ruling on this regulation. THEREFORE: In exercise of the powers granted by Article 245, numeral 11) of the Constitution of the Republic and in application of Articles 11, 116, 118, numeral 2) and 119 of the General Public Administration Law; 41 and 42 of the Administrative Procedure Law and 19 of Decree No. 230-2010 containing the National Program for Employment by Hours.
