This decree reforms Honduras' Criminal Code to combat crimes such as human trafficking, land usurpation, extortion, money laundering, and smuggling. It increases penalties for these offenses and creates faster procedures to evict illegally occupied properties, protecting private property and promoting citizen security and investments.

Considerations

Whereas over the last thirty (30) years we have experienced alterations in social behavior, specifically in criminal conduct that are attributable, among other factors, to the development of commercial and cultural exchange activities at a global level, the dominance of advanced technologies, particularly those related to information technology and telecommunications, and the opportunities generated by the socio-economic evolution of peoples associated with political and commercial openness, which generate positive results and habits and equally negative results and habits, many of the latter manifested in the appearance of new criminal figures.

Whereas the crime rates in our country demand the strengthening of appropriate legislative tools to combat crime in all its forms.

Whereas on May 10, 2019, Decree No. 130-2017 was published in the Official Journal "La Gaceta", which was approved by this Branch of State on January 18, 2018, and contains the New Criminal Code of Honduras.

Whereas following the publication in the Official Journal "La Gaceta" of the aforementioned Decree, it became necessary to open a space for review and socialization so that the sectors that had any proposal or concern could present their concerns in greater detail, and thus, after presenting technical assessments, if necessary, the required adjustments could be made to the text of the Code.

Whereas as a result of the aforementioned dialogue, it was deemed appropriate that to better guarantee the protection against human trafficking and public safety in general, as well as the promotion of investments, it is necessary to make adjustments to several articles of the new Criminal Code contained in Decree No. 130-2017.

Whereas Private Property is essential for the functioning of the free market system, being a means of progress for nations, encouraging both foreign and national investment, providing clear rules for the legal protection of investments.

Whereas the judicial bodies lack an agile and effective norm to guarantee Private Property, and face new forms and organizations dedicated repeatedly to the illicit activity of usurpation.

Whereas the Criminal Procedural Code enshrines within its principles the Neutralization of the Effects of Crime, as it is the duty of the Judicial Branch to carry out such neutralization, in the case of usurpation due to the nature of the crime itself, it must be done in a preventive manner, avoiding the consolidation of said crime with the construction of any infrastructure that allows the material or intellectual authors of the crime the consolidation of a simulated act of peaceful possession, which is the reason why they file amparo motions, requesting respect for guarantees that, through simulated acts, they intend to obtain.

Whereas after the effectiveness of Decree No. 144-2014 which contains the "Special Law Against Money Laundering", it is advisable to conduct a review, implementation, and standardization of administrative procedures, to achieve an effective comprehensive fight against the commission of the different criminal offenses that result in the legitimation of economic gains generated by organized crime, without injuring the constitutional rights of those investigated.

Whereas in accordance with Article 205, Attribution 1) of the Constitution of the Republic, it is within the power of the National Congress to: "Create, decree, interpret, reform, and repeal laws".
