This decree reforms the Public-Private Partnership Law to establish limits on state contributions to private projects and create controls over tax exemptions. It requires exemption requests to go through the Ministry of Finance and allows cancellation of tax benefits if misuse is proven, thus protecting public revenues.

Considerations

Given that, in accordance with Article 351 of the Constitution of the Republic, the National Tax System shall be governed by the principles of legality, proportionality, generality, and equity, in accordance with the economic capacity of the taxpayer.

Given that only indirect taxes are direct charges to the programs and projects that in turn increase the prices and costs that the State of Honduras must pay to investors and private operators under Public-Private Partnership contracting processes.

Given that it is necessary to establish the necessary mechanisms for the control and rationalization of exemptions.

Given that the Law of Fiscal Responsibility contained in Decree No. 25-2016 of April 7, 2016 published in the Official Gazette "La Gaceta" on May 4, 2016, in articles 5 numeral 3) subsection d) and 18, establishes the quantification and systematic and annual publication of exemptions and exonerations.

Given that, in accordance with Article 205, Article 1 of the Constitution of the Republic, the exclusive authority of the National Congress: to create, enact, interpret, reform, and repeal laws.
