This law allows private companies to work with the State on infrastructure and public service projects through public-private partnerships (PPPs). It creates two institutions: COALIANZA to manage these projects and a Superintendent's office to oversee them. It benefits the country by attracting private investment to build and operate public works while the State maintains control and supervision.

Considerations

Whereas Honduras is a State of law, sovereign, constituted as a free, democratic and independent Republic to ensure its inhabitants the enjoyment of justice, freedom, culture and economic and social well-being.

Whereas it is a duty of the State to seek national and foreign investment by providing them with sufficient and necessary guarantees in their investments.

Whereas in the face of the global economic crisis that notably affects Honduras, it is necessary that the country's authorities take the measures they deem appropriate to generate investment and create sources of employment.

Whereas it is a duty of the National Congress to enact laws that tend toward the achievement of the common welfare of the people and the attainment of better living standards in all aspects.

Whereas in accordance with Article 56 of Executive Decree Number PCM-008-97, amended by Executive Decree Number PCM-002-2001, published in the Official Gazette La Gaceta on April 23, 2001, it corresponds to the General Directorate of Economic Integration and Commercial Policy the responsibility for the formulation, execution and evaluation of commercial integration policies, bilateral and regional, as well as to address other matters related to the resolution of disputes arising from the application and interpretation of the regulations of existing commercial treaties, and to direct commercial and investment negotiations, bilateral, regional and multilateral, represent the country within the framework of the negotiations of the World Trade Organization and in other international commercial forums where treaties, agreements and in general, matters of trade and investment are discussed.

Whereas in the free trade agreement between Dominican Republic, Central America - United States (RD-CAFTA) approved by Decree No. 10-2005 and in force as of April 1, 2006, the establishment of a list of national arbitrators is provided for.

Whereas in order to provide greater transparency, publicity and equal opportunities in the designation of candidates to compose the lists of candidates for arbitrators, it is necessary to have a mechanism to integrate the list of candidates for arbitrators.
