This decree reforms the General Mining Law to restore regulations that had been declared unconstitutional. It establishes new concession periods (20 years for non-metallic, 30 for metallic minerals), requires citizen consultation before exploitation, mandates environmental licenses, and implements special mining taxes of 3% to 5% on FOB value to fund municipalities and the mining authority.

Considerations

Whereas the Constitution of the Republic in its Article 316 establishes that judgments declaring the unconstitutionality of a norm shall be of immediate execution and shall have general effects, and therefore shall repeal the unconstitutional norm, and must be communicated to the National Congress, which shall cause it to be published in the Official Gazette "La Gaceta".

Whereas by means of Decree No. 238-2012 dated January 23, 2013, the National Congress approved the General Mining Law, which has as its purpose to regulate mining and metallurgical activities in the country, published on April 2, 2013, in the Official Gazette "La Gaceta", in Edition No. 33.088.

Whereas the General Mining Law establishes that the State of Honduras exercises immediate, inalienable, and imprescriptible dominion over all mineral resources found in national territory, and must establish the bases for their development by private parties in accordance with the social interest.

Whereas on June 23, 2017, the Constitutional Chamber of the Supreme Court of Justice (CSJ), by unanimous vote, on the merits, declared the Unconstitutionality of Articles 22, 27, 56, 67, 68, and 76 of the General Mining Law. This judgment became final on August 9, 2017 and was published in the Official Gazette "La Gaceta" No. 34.479 on October 31, 2017.

Whereas since the publication of the Declaration of Unconstitutionality to the present date, the State and the Municipalities have ceased to receive approximately Five Hundred Million Lempiras (L. 500,000,000.00).

Whereas it is imperative to reform the General Mining Law in order to confront and resolve the current crisis of the governing entity of the Mining Sector and to strengthen it through a process of regulating all those areas of the country where mining exists illegally, providing support and follow-up so that they may develop their projects in compliance with legal, technical, and environmental norms.

Whereas in accordance with Article 205 Attribution 1) of the Constitution of the Republic, it is the responsibility of the National Congress to: Create, decree, interpret, reform, and repeal laws.
