This agreement creates UPLAFT, a specialized unit within the Public Works Secretary to prevent money laundering and terrorism financing. Considerations

Whereas the Constitution of the Republic establishes that: "The Secretaries of State are collaborators of the President of the Republic in the orientation, coordination, direction and supervision of the organs and entities of the national public administration in the area of their competence"; and the General Law of Public Administration attributes to the Secretary of State in the Offices of Public Works, Transportation and Housing (SOPTRAVI), among other functions; those matters concerning the formulation, coordination, execution and evaluation of policies related to housing, public infrastructure works, the road system, urban planning and transportation; as well as the concessionaire system for public works.

Whereas the State of Honduras has subscribed to and ratified several International Treaties and Conventions, both within the framework of the United Nations Organization (UN), Organization of American States (OAS), as well as at the Regional level; among them, the United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances (Vienna Convention of 1988); the United Nations Convention Against Transnational Organized Crime; ratified on July 30, 2003; the Inter-American Convention against Corruption, approved by the Organization of American States (OAS) on March 29, 1996; the Inter-American Convention against Terrorism held on June 3, 2002; the Agreement between Central America and the Dominican Republic on Drugs and Money Laundering, Prevention and Suppression of Money and Asset Laundering Crimes, with Illicit Drug Trafficking and Related Crimes.

Whereas the National Congress of the Republic, through Decree No. 45-2002 dated March 5, 2002, published in "La Gaceta", Official Gazette of the Republic on May 15 of that same year, approved the Law Against the Crime of Money Laundering, which constitutes an important instrument for the application of mechanisms and strategies for the prevention and combat of that scourge, as well as that related to Terrorism Financing and related crimes; and that same Power of the State approved the Law Against Terrorism Financing, through Decree No. 241-2010 dated November 18, 2010, published in "La Gaceta", Official Gazette of the Republic, in its edition No. 32,389 of December 11 of that same year; whose purpose is to establish measures for prevention, location, suppression and control of activities aimed at financing terrorist activities, establish precautionary measures or their forfeiture or confiscation, of assets or funds, that belong to persons or organizations linked with terrorist acts or activities, the application of the provisions contained in the Convention for the Suppression of the Financing of Terrorism of 1999, Resolution 1373 of 2001 of the United Nations Security Council, as well as other Agreements and International Instruments ratified by the State of Honduras and the Resolutions that on this matter have been issued by the United Nations Security Council.

Whereas the Executive Power within the framework of the commitments acquired with the Subscription and Ratification of International Treaties and Conventions on the matter of Money Laundering and Terrorism Financing; through its Institutions, subscribed on February 28, 2010, an INTERINSTITUTIONAL COOPERATION AGREEMENT FOR THE FORFEITURE OF PROPERTY OF ILLICIT ORIGIN, PREVENTION OF MONEY LAUNDERING AND TERRORISM FINANCING, to which this Secretary of State adhered on April 25, 2013 and where it is recognized that all parties have obligations determined by Law, for the prevention, investigation, sanction and reintegration, in the crimes of money laundering, terrorism financing and related crimes; and that the State of Honduras has made a great effort to implement the Forfeiture of Property system, as a tool to combat crime, in order to divest criminal organizations of their economic resources and weaken their operational capacity; therefore it is necessary to have a Specialized Unit on the matter within this Secretary of State.

Whereas it is the duty and responsibility of Secretaries of State, among others: "To issue Agreements and Resolutions in matters of their competence and those delegated by the President of the Republic, and to ensure their execution. The signature of the Secretaries of State in these acts shall be authorized by the respective General Secretaries".
