This law creates a new District Court in Choloma, Cortés, that handles criminal, civil, family, labor, and other cases. It affects Choloma residents who need closer and faster access to justice, avoiding travel to San Pedro Sula. It aims to improve judicial efficiency and bring justice services closer to the local population.

Considerations

Whereas Decree 262-2000, published in the Official Gazette "La Gaceta" on the twentieth of February 2001, establishes as an attribution of the Supreme Court of Justice among others "...11) To establish the division of territory for jurisdictional purposes; 12) To create, suppress, merge or transfer the Courts of First Instance, Courts of Appeals and other dependencies of the Judicial Branch..."

Whereas within the framework of the Judicial Branch Modernization Plan 2004-2009 approved by the Plenary of the Supreme Court of Justice, four strategic lines are outlined, with number one being "the improvement of the operational capacity of the jurisdictional and administrative structure of the Judicial Branch," establishing as a specific objective "to achieve efficiency and effectiveness in the functioning of jurisdictional jurisdiction to satisfy the demand of users in an expeditious, timely and quality manner," through specific actions among which stand out: Promote the implementation of orality and simplification of procedures in the different matters. Review and restructure territorial and subject matter jurisdiction. Design and implement models of organization, functioning and management of judicial offices.

Whereas the Judicial Branch of Honduras through periodic monitoring of the strategies and actions established in the modernization plan of this Power of the State has initiated a process of incorporation of new management models in judicial offices that have been implemented with the Merger of the Criminal Courts of First Instance of the cities of Tegucigalpa and San Pedro Sula and the merger of the Courts of First Instance and Justice of the Peace in civil matters of the departments of Francisco Morazán and Cortés, as well as other mergers in the different matters, also contemplating the jurisdictional reorganization of other Courts to achieve greater effectiveness and accessibility to Justice.

Whereas it corresponds to the Judicial Branch in the matter of administration of justice to judge and execute what has been judged, which entails creating specialized instances to provide a better response and facilitate access to justice in the issues of the different matters such as Criminal, Civil, Family, Children and Adolescence, Landlord-Tenant, Domestic Violence, and Labor.

Whereas to guarantee a system that permits transparency, agility, access, implementation of orality and new services common to the user, it is imperative to create new Courts of First Instance to ensure attention in a comprehensive and expeditious manner of the judicial proceedings that are heard in the jurisdiction of the existing Courts of First Instance.
