Summary
This agreement creates the Police High School as a school under the National Police to educate the children of active, retired, and deceased police officers. The school will offer quality bilingual education at pre-basic, basic, and secondary levels, based on discipline and civic values. The Security Ministry must allocate budget for its operation and request authorization from the Education Ministry.
Considerations
Whereas the Constitution of the Republic in Article 293 states: "The National Police is a professional permanent Institution of the State, apolitical in the partisan sense, of purely civil nature, charged with ensuring the preservation of public order, the prevention, control and combat of crime; protect the security of persons and their property; Execute the resolutions, dispositions, mandates and legal decisions of the authorities and public officials, all with strict respect for human rights. The National Police shall be governed by special legislation". CONSIDERING: That the Constitution of the Republic in Articles 321 and 323 respectively establish: Article 321: "State officials have no more powers than those expressly granted to them by the Secretariat of State in the Office of Security. All acts that they execute outside the law are void and imply responsibility"; "Article 323. Officials are depositaries of authority, legally responsible for their official conduct, subject to the law and never superior to it. No official or employee, civil or military, is obliged to comply with illegal orders or those that imply the commission of a crime". CONSIDERING: That the Constitution of the Republic in Article 247 states: "The Secretaries of State are collaborators of the President of the Republic in the orientation, coordination, direction and supervision of the organs and entities of the national public administration, in the area of their competence". CONSIDERING: That the General Law of Public Administration, in its Article 36 numerals 1) and 8) establishes that the attributions and common duties of the Secretaries of State are: "To orient, direct, coordinate, supervise and control the activities of their respective offices, without prejudice to the attributions that the Constitution and laws confer to other organs"; "Emit the Agreements and Resolutions in the matters of their competence and those delegated to them by the President of the Republic and ensure their execution. The signature of the Secretaries of State, in these cases shall be authorized by the respective General Secretaries". CONSIDERING: That through EXECUTIVE AGREEMENT No. 155-2023 dated June 21, 2023, the Constitutional President of the Republic appointed the citizen HÉCTOR GUSTAVO SÁNCHEZ VELÁSQUEZ, to the position of Secretary of State in the Office of Security.
Whereas the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras, in its article 4 establishes: "OTHER DEPENDENCIES. THE SECRETARIAT has the structure with the dependencies that are established in this Law or its Regulations, as well as those determined by the Secretary of State in the Office of Security, prior Technical Recommendation of the Strategic Police Board, for those dependencies linked to the operational level of police activity". CONSIDERING: That the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras, in its article 7 numerals 1, 4, 5, 7, 19 and 20 states: "FUNCTIONS OF THE SECRETARY OF STATE IN THE OFFICE OF SECURITY. In addition to those consigned in other laws, it corresponds to the Head of the Secretariat of State in the Office of Security to: 1) Comply and ensure compliance with the Constitution of the Republic, Treaties and International Conventions ratified by Honduras, Laws, Regulations and other applicable legal dispositions within the scope of their functions; ...4) Ensure the correct functioning of THE SECRETARIAT and the National Police; 5) Manage, execute and administer the Budget of THE SECRETARIAT approved by the Legislative Power and supervise the execution of the Budget allocated to the National Police; ...7) Issue general directives of an administrative, budgetary and functional nature of THE SECRETARIAT and the National Police; ...19) Develop and implement Social Welfare and Health Policies, both for officials of THE SECRETARIAT and for members of the Police Career; and, 20) The others that by reason of their position are in accordance with the Law and its regulations".
Whereas Article 95 of the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras, related to Article 103 of the General Regulation of the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras, which establish: "Police Education System and the Directorate of Police Education (DEP). The Police Education System is the set of police organisms responsible for fulfilling the objectives, strategies and policies of professional development of police officers at their different educational levels, in accordance with institutional needs and the directives issued by the Directorate of Police Education (DEP) in coordination with the Directorate of Planning, Operational Procedures and Continuous Improvement, as appropriate..."; likewise the Police Education System is responsible for managing cultural change within and outside the Police Institution, through the adoption of the community service model and promotion, dissemination, training in matters of security, coexistence and promotion of relations between the community and the Police. CONSIDERING: That through EXECUTIVE AGREEMENT No.1363-SE-2014 dated August 22, 2013, published in the Official Gazette "La Gaceta" on September 17, 2014, publication No.33,533, the REGULATION OF NON-GOVERNMENTAL EDUCATIONAL INSTITUTIONS was created, established as a normative framework to assist the right that any natural or legal person has to found educational centers and to ensure parents, the right to choose the type of education they wish for their children, therefore the State established this regulation so that Non-Governmental Educational Institutions provide quality, permanent and inclusive education for all students, which collaborate with the State in its essential function of developing quality education with permanent and inclusive equity. CONSIDERING: That the REGULATION OF NON-GOVERNMENTAL EDUCATIONAL INSTITUTIONS, in its Articles 2 and 11 establishes: "Non-Governmental Educational Institution shall be understood as that created and administered with resources of natural or legal persons, to offer one or more educational services; its administration shall be private in nature; its ownership may be personal, community, cooperative, commercial and any other form of legally recognized administration..."; "Non-Governmental Educational Centers may offer their services in the levels, modalities and specialties of formal education authorized, organized, directed and supervised by the Secretariat of State in the Office of Education... The authorization for creation and operation of a Non-Governmental Educational Institution shall be given by the Secretariat of State in the Office of Education, through the respective Departmental Directorate of Education. The authorization for creation and operation shall be made for the level, modality and specialty requested, provided that it is accredited that the promoters or administrators have no pending accounts with justice, have financial and technical-pedagogical capacity and other requirements established by this regulation".
Whereas the Educational System of the Police High School shall have a Curricular approach that evokes the National Education Program, including Information and Communication technologies, promoting competencies in the Areas of Science, Technology, Art, Culture, Civic Education and Sports, which shall be endorsed by the Secretariat of State in the Office of Education and shall be intended for the children of members of the Secretariat of State in the Office of Security and the National Police.
Whereas the General Regulation of the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras, in its article 9 states: "TECHNICAL REPORT. To create, modify, merge or eliminate dependencies linked to the Operational Level of THE SECRETARIAT which corresponds to THE POLICE, the Secretary of State must request a Technical Report from the Strategic Police Board. Such Technical Report must contain an analysis of the causes that justify the modification, the purpose, administrative feasibility, impact and an estimated cost of operation when it is the Creation of a new organ of THE POLICE, which must have the corresponding budgetary availability and with the understanding that a new organ should not be created when it implies duplication of functions with others already existing". CONSIDERING: That the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras, in its Article 44 indicates: "CREATION OF DEPENDENCIES. The General Director of the National Police may request the Secretary of State in the Office of Security so that through an Agreement he may create, eliminate, modify and merge the Directorates, Divisions, Departments, Sections, Units and other Dependencies that are necessary for the better organization and functioning of the National Police, in accordance with the needs of the service, for which he may request Technical Recommendation from the Strategic Police Board".
Whereas the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras, in its Article 54 first paragraph indicates: "STRATEGIC POLICE BOARD. It is a superior advisory, coordination, organization, planning and joint operational supervision organ, evaluation and assessment of police actions and procedures, so that they are carried out within the framework of the Law, regulations and established protocols".
Whereas the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras, in its Article 57 establishes: "FUNCTIONS OF THE STRATEGIC POLICE BOARD. The Strategic Police Board has the following functions: 1) Advise, analyze, design and present possible courses of action for decision-making, strategies on plans and programs both administrative and operational under execution; ...5) Advise on the advisability in relation to the Creation, Elimination or Merger of Police Dependencies, according to the needs of the service". CONSIDERING: That through SESSION MINUTES OF THE STRATEGIC BOARD OF THE NATIONAL POLICE NUMBER 037-2025 dated April 10, 2025, the Strategic Board of the National Police of Honduras discussed, analyzed extensively and by Unanimous Vote determined that the creation of the "POLICE HIGH SCHOOL" be proposed, based on the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras (Decree 18-2017), Articles 47 numerals 3, 7, 9, Article 54 first paragraph and Article 57 numerals 1, 4, 5, 6 and 12. CONSIDERING: That through TECHNICAL OPINION DGPN-DEP No.037-2025 dated April 10, 2025, the Strategic Police Board, OPINED: Proposes the Creation of the "POLICE HIGH SCHOOL", as a Dependency of the Directorate of Police Education (DEP) with the purpose of providing quality education, incorporating a comprehensive approach to the children of members of the Secretariat of State in the Office of Security and the National Police, also incorporating a comprehensive approach that strengthens both academic and linguistic competencies of students, based on discipline, values and civic principles, forming integral citizens with a vocation for service and capacity to contribute to the development of Honduras.
Whereas the Legal Services Unit of the Secretariat of State in the Office of Security, through LEGAL OPINION SEDS-USL-No. 200-2025 dated April 11, 2025, Opined on the Appropriateness of the Creation of the POLICE HIGH SCHOOL, as a dependency of the Police Education System/Directorate of Police Education (DEP) of the General Directorate of the National Police, with the purpose of providing the children of personnel of the Secretariat of State in the Office of Security and children of members of the National Police of Honduras active and those who died during service, a bilingual education of excellence, based on discipline, values and civic principles, forming integral citizens with a vocation for service and capacity to contribute to the development of Honduras, by virtue of the fact that in accordance with the contents of MEMORANDUM SEDS-No.0652-2025, the Secretary of State in the Office of Security, instructed that the procedure corresponding to Law be continued and in consonance with what is established in the SESSION MINUTES OF THE STRATEGIC BOARD OF THE NATIONAL POLICE and TECHNICAL OPINION DGPN-DEP where the Appropriateness for the creation of the "POLICE HIGH SCHOOL" was Opined, with the purpose of providing an educational service at the levels: Pre-Basic, Basic and Secondary.
Whereas Article 23 of the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras and 26 of its General Regulation, among others, provides: "The Administrative Management, for the efficient fulfillment of its attributions, is in charge of the direction, coordination and supervision... of the Budget Sub-management" and Article 28 of the General Regulation of the Organic Law of the Secretariat of State in the Office of Security and the National Police of Honduras, which establishes: "The Budget Sub-management is responsible for administering, directing, controlling and preparing the budget allocated to THE SECRETARIAT and monitoring its execution, as well as efficiently maintaining the accounting-financial record of resources, the review and control of spending, in accordance with general budget provisions and other applicable regulations".

“Los servidores del Estado no tienen más facultades que las que expresamente les confiere Secretaría de Estado en el Despacho de Seguridad ACUERDO SEDS NÚMERO 643-2025 SECRETARÍA DE ESTADO EN EL DESPACHO DE SEGURIDAD COMAYAGÜELA, M.D.C., 22 DE ABRIL DEL AÑO 2025 CONSIDERANDO: Q u e l a C o n s t i t u c i ó n d e l a República sus Artículos 157, 162 y 166 indican: Artículo 157: “La educación en todos los niveles del sistema educativo formal, excepto el nivel superior, será autorizada, organizada, dirigida y supervisada exclusivamente por el Poder Ejecutivo por medio de la Secretaría de Educación, la cual administrará los centros de dicho sistema que sean totalmente financiados con fondos públicos”;
“Por su carácter informativo y formativo, la docencia tiene una función social y humana que determina para el educador responsabilidades científicas y morales frente a sus discípulos, a la institución en que labore y a la sociedad”; Artículo 166: la ley. Todo acto que ejecuten fuera de la ley es nulo e implica responsabilidad”; “Artículo 323. Los funcionarios son depositarios de la autoridad, responsables legalmente por su conducta oficial, sujetos a la ley y jamás superiores a ella. Ningún funcionario o empleado, civil o militar, está obligado a cumplir órdenes ilegales o que impliquen la comisión de delito”. CONSIDERANDO: Q u e l a C o n s t i t u c i ó n d e l a República en el Artículo 247 refiere: “Los Secretarios de Estado son colaboradores del Presidente de la República en la orientación, coordinación, dirección y supervisión de los órganos y entidades de la administración pública nacional, en el área de su competencia”. CONSIDERANDO: Q u e l a L e y G e n e r a l d e l a Administración Pública, en su
numerales 1) y 8) establece que son atribuciones y deberes comunes a los Secretarios de Estado: “Orientar, dirigir, coordinar, supervisar y controlar las actividades de sus respectivos despachos, sin perjuicio de las atribuciones que la Constitución y las leyes confieran a otros órganos”; ¨Emitir los Acuerdos y Resoluciones en los asuntos de su competencia y aquellos que le delegue el Presidente de la República y cuidar de su ejecución. La firma de los Secretarios de Estado, en estos casos será autorizada por los respectivos Secretarios Generales”. CONSIDERANDO: Q u e m e d i a n t e A C U E R D O EJECUTIVO No. 155-2023 de fecha 21 de junio del Año 2023, la señora Presidenta Constitucional de la República nombró al ciudadano HÉCTOR GUSTAVO SÁNCHEZ VELÁSQUEZ, en el cargo de Secretario de Estado en el Despacho de Seguridad. CONSIDERANDO: Que la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional de Honduras, en su artículo 4 establece: “ O T R A S D E P E N D E N C I A S . L A S E C R E T A R Í A t i e n e l a estructura con las dependencias que se establecen en esta Ley o sus Reglamentos, así como aquellas que determine el Secretario de Estado en el Despacho de Seguridad, previa Recomendación Técnica del Directorio Estratégico Policial, para aquellas dependencias vinculadas al nivel operativo de la actividad policial”. CONSIDERANDO: Q u e l a L e y O r g á n i c a d e l a S e c r e t a r í a d e E s t a d o e n e l Despacho de Seguridad y de la Policía Nacional de Honduras, en su artículo 7 numerales 1, 4, 5, 7, 19 y 20 dice: “FUNCIONES DEL SECRETARIO DE ESTADO EN EL DESPACHO DE SEGURIDAD. Además de las consignadas en otras leyes, corresponde al Titular de la Secretaría de Estado en el Despacho de Seguridad: 1) Cumplir y velar por el cumplimiento de la Constitución de la República, Tratados y C o n v e n i o s I n t e r n a c i o n a l e s ratificados por Honduras, Leyes, Reglamentos y demás disposiciones legales aplicables dentro del ámbito de sus funciones; …4) Velar por el correcto funcionamiento de LA SECRETARÍA y la Policía Nacional; 5) Gestionar, ejecutar y administrar el Presupuesto de LA SECRETARÍA aprobado por el Poder Legislativo y, supervisar la ejecución del Presupuesto asignado a la Policía Nacional; …7) Emitir directrices generales de orden administrativo, presupuestario y funcional de LA SECRETARÍA y de la Policía Nacional; …19) D e s a r r o l l a r e i m p l e m e n t a r Políticas de Bienestar Social y Sanidad, tanto para funcionarios de LA SECRETARÍA, como para miembros de la Carrera Policial; y, 20) Las demás que a razón de su cargo sean de conformidad con la Ley y sus reglamentos”. CONSIDERANDO: Que el Artículo 95 de la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional de Honduras, relacionado con el Artículo 103 del Reglamento General de la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional de Honduras, que establecen: “Sistema de Educación Policial y la Dirección de Educación Policial (DEP). El Sistema de Educación Policial es el conjunto de organismos policiales responsables de cumplir los objetivos, estrategias y políticas de desarrollo profesional de los policías en sus distintos niveles educativos, conforme a las necesidades institucionales y a las directrices emitidas por la Dirección de Educación Policial (DEP) en coordinación con la Dirección de Planeamiento, Procedimientos Operativos y Mejora Continua, en su caso…”; de igual manera el Sistema de Educación Policial tiene a su cargo la gestión del cambio cultural a lo interno y externo de la Institución Policial, mediante la adopción del modelo de servicio comunitario y promoción, difusión, capacitación en materia de seguridad, convivencia y fomento de las relaciones entre la comunidad y la Policía. CONSIDERANDO: Q u e m e d i a n t e A C U E R D O EJECUTIVO No.1363-SE-2014 de fecha 22 de agosto del año 2013, publicado en el Diario Oficial “La Gaceta” en fecha 1 7 d e s e p t i e m b r e d e l a ñ o 2014, publicación No.33,533, se creó el REGLAMENTO D E I N S T I T U C I O N E S D E E D U C A C I Ó N N O G U B E R N A M E N T A L E S , establecido como marco normativo para asistir el derecho que tiene toda persona natural o jurídica para fundar centros educativos y para asegurar a los padres de familia, el derecho a escoger el tipo de educación que deseen para sus hijos, por lo que el Estado estableció esta normativa para que las Instituciones de Educación No Gubernamentales, brinden una educación de calidad, permanente e inclusiva para todos los educandos, mismas que colaboran con el Estado en su función esencial de desarrollar una educación de calidad con equidad permanente e inclusiva. CONSIDERANDO: Q u e e l R E G L A M E N T O D E I N S T I T U C I O N E S D E E D U C A C I Ó N N O GUBERNAMENTALES, en sus Artículos 2 y 11 establece: “Se entenderá por Institución de Educación No Gubernamental, la creada y administrada con recursos propios de personas naturales o jurídicas, para ofrecer uno o más servicios educativos; su administración será de carácter privado; su propiedad podrá ser personal, comunitaria, c o o p e r a t i v a , c o m e r c i a l y de cualquier otra forma de a d m i n i s t r a c i ó n l e g a l m e n t e reconocida…”; “Los Centros Educativos No Gubernamentales podrán ofrecer sus servicios en los niveles, modalidades y especialidades de la educación formal autorizados, organizados, dirigidos y supervisados por la Secretaría de Estado en el Despacho de Educación… La autorización de creación y funcionamiento de una Institución de Educación No Gubernamental, la dará la Secretaría de Estado en el Despacho de Educación, a través de la respectiva Dirección Departamental de Educación. La autorización de creación y funcionamiento, se hará para el nivel, modalidad y especialidad s o l i c i t a d a , s i e m p r e q u e s e acredite que los promotores o administradores no tienen cuentas pendientes con la justicia, tienen capacidad financiera y técnico- pedagógica y demás requisitos que establece el presente reglamento”. CONSIDERANDO: Que el Sistema Educativo del Liceo Policial, tendrá un enfoque C u r r i c u l a r q u e e v o q u e e l Programa Nacional de Educación, incluyendo las tecnologías de la Información y de la Comunicación, promoviendo competencias en las Áreas de la Ciencia, Tecnología, Arte, Cultura, Cívica y Deporte, mismo que estará avalado por la Secretaría de Estado en el Despacho de Educación y estará destinado a los hijos de los miembros de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional. CONSIDERANDO: Que el Reglamento General de la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional de Honduras, en su artículo 9 versa: “INFORME TÉCNICO. Para crear, modificar, fusionar o suprimir dependencias vinculadas al Nivel Operativo de LA SECRETARÍA el cual corresponde a LA POLICÍA, el Secretario de Estado debe requerir Informe Técnico del Directorio Estratégico Policial. Dicho Informe Técnico debe contener un análisis de las causas que justifican la modificación, la finalidad, factibilidad administrativa, impacto y un estimado de los costos de funcionamiento cuando sea la Creación de un nuevo órgano de LA POLICÍA debiendo contar con la disponibilidad presupuestaria correspondiente y bajo el entendido que no debe crearse un nuevo órgano cuando implique duplicación de funciones con otros ya existentes”. CONSIDERANDO: Q u e l a L e y O r g á n i c a d e l a S e c r e t a r í a d e E s t a d o e n e l Despacho de Seguridad y de la Policía Nacional de Honduras, en su Artículo 44 indica: “CREACIÓN DE DEPENDENCIAS. El Director General de la Policía Nacional puede solicitar al Secretario de Estado en el Despacho de Seguridad para que éste mediante Acuerdo pueda crear, suprimir, modificar y fusionar las Direcciones, Divisiones, D e p a r t a m e n t o s , S e c c i o n e s , Unidades y demás Dependencias que sean necesarias para la mejor organización y funcionamiento de la Policía Nacional, conforme a las necesidades del servicio, para lo cual puede solicitar Recomendación Técnica del Directorio Estratégico Policial”. CONSIDERANDO: Que la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional de Honduras, en su Artículo 54 párrafo primero indica: “DIRECTORIO ESTRATEGICO POLICIAL. Es un Órgano superior de asesoría, c o o r d i n a c i ó n , o r g a n i z a c i ó n , planificación y supervisión operativa conjunta, evaluación y valoración de las actuaciones y procedimientos policiales, a fin que se realicen en el marco de la Ley, reglamentos y protocolos establecidos”. CONSIDERANDO: Que la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional de Honduras, en su Artículo 57 establece: “FUNCIONES DEL DIRECTORIO ESTRATÉGICO P O L I C I A L . E l D i r e c t o r i o Estratégico Policial, tiene las funciones siguientes: 1) Asesorar, analizar, diseñar y presentar los cursos de acción posibles para la toma de decisiones, estrategias sobre los planes y programas tanto administrativos, como operativos en ejecución; …5) Asesorar sobre la conveniencia en relación a la Creación, Supresión o Fusión de Dependencias Policiales, según las necesidades del servicio”. CONSIDERANDO: Q u e m e d i a n t e A C T A D E SESIÓN DEL DIRECTORIO ESTRATÉGICO DE LA POLICÍA NACIONAL NÚMERO 037-2025 de fecha 10 de abril del Año 2025, el Directorio Estratégico de la Policía Nacional de Honduras, discutió, analizó ampliamente y por Unanimidad de Votos determinan que se proponga la creación del “LICEO POLICIAL”, con fundamento en la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional de Honduras (Decreto 18-2017), Artículos 47 numerales 3, 7, 9, Artículo 54 párrafo primero y Artículo 57 numerales 1, 4, 5, 6 y 12. CONSIDERANDO: Q u e m e d i a n t e D I C T A M E N TÉCNICO DGPN-DEP No.037- 2025 de fecha 10 de abril del año 2025, el Directorio Estratégico P o l i c i a l , D I C T A M I N Ó : P r o p o n e r l a C r e a c i ó n d e l “LICEO POLICIAL”, como una Dependencia de la Dirección de Educación Policial (DEP) con la finalidad de brindar una educación de calidad, incorporando un enfoque integral a los hijos de los miembros de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional, incorporando también un enfoque integral que fortalezcan tanto las competencias académicas y lingüísticas de los estudiantes, basada en disciplina, valores y principios cívicos, formando ciudadanos íntegros con vocación de servicio y capacidad para contribuir al desarrollo de Honduras. CONSIDERANDO: Que la Unidad de Servicios Legales de la Secretaría de Estado en el Despacho de Seguridad, mediante DICTAMEN LEGAL S E D S - U S L - N o . 2 0 0 - 2 0 2 5 d e fecha 11 de abril del Año 2025, Dictaminó la Procedencia de la Creación del LICEO POLICIAL, como dependencia del Sistema de Educación Policial/Dirección de Educación Policial (DEP) de la Dirección General de la Policía Nacional, con la finalidad de brindar a los hijos del personal de la Secretaría de Estado en el Despacho de Seguridad e hijos de los miembros de la Policía Nacional de Honduras activos y de los que fallecieron durante el servicio, una educación bilingüe de excelencia, basada en disciplina, valores y principios cívicos, formando ciudadanos íntegros con vocación de servicio y capacidad para contribuir al desarrollo de Honduras, en virtud que conforme lo contenido en el MEMORANDUM SEDS- No.0652-2025, el Secretario de Estado en el Despacho de Seguridad, instruyó que se continúe con el trámite que corresponde conforme a Ley y en consonancia a lo establecido en el ACTA DE SESIÓN DEL DIRECTORIO ESTRATÉGICO DE LA POLICÍA NACIONAL y DICTAMEN TÉCNICO DGPN-DEP donde se Dictaminó la Procedencia para la creación del “LICEO POLICIAL”, con la finalidad de brindar un servicio educativo en los niveles: Pre-Básica, Básica y Media. CONSIDERANDO: Que el Artículo 23 de la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional de Honduras y 26 de su Reglamento General, entre otras, dispone: “La Gerencia Administrativa, para el eficiente cumplimiento de sus atribuciones tiene a su cargo la dirección, coordinación y supervisión… de la Subgerencia de Presupuestos” y el Artículo 28 del Reglamento General de la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional de Honduras, que establece: “La Subgerencia de Presupuestos está a cargo de administrar, dirigir, controlar y preparar el presupuesto asignado a LA SECRETARÍA y dar seguimiento a su ejecución, así como de llevar de forma eficiente el registro contable-financiero de los recursos, la revisión y control del gasto, de acuerdo con las disposiciones generales de presupuesto y demás normativa aplicable”. POR TANTO El Secretario de Estado en el Despacho de Seguridad, en nombre del Estado de Honduras, en uso de las facultades del que está investido y en aplicación de los Artículos 157, 162, 166, 247, 293, 321 y 323 de la Constitución de la República; Artículos 7, 29 numeral 4), Artículo 36 numerales 1), 8), Artículos 116, 118, 119, 120 y 122 de la Ley General de la Administración Pública; Artículos 19, 22, 23, 24, 25, 26 y 27 de la Ley de Procedimiento Administrativo; Artículos 1, 4, 7 numerales 1), 4), 5), 7), 19) y 20), Artículos 23, 44, 54, 57 y 95 de la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y de la Policía Nacional de Honduras; Artículo 11 numeral 11 de la Ley de la Carrera Policial; Artículos 9, 26, 28, 78 y 103 del Reglamento General de la Ley Orgánica de la Secretaría de Estado en el Despacho de Seguridad y la Policía Nacional de Honduras; REGLAMENTO DE INSTITUCIONES NO GUBERNAMENTALES (ACUERDO EJECUTIVO No.1363-SE-2014), ACTA DE SESIÓN DEL DIRECTORIO ESTRATÉGICO DE LA POLICÍA NACIONAL NÚMERO 037-2025 de fecha 10 de abril del Año 2025, DICTAMEN TÉCNICO DGPN-DEP No.037-2025 de fecha 10 de abril del año 2025, emitidos por el Directorio Estratégico Policial y DICTAMEN LEGAL SEDS-USL-No.200-2025 de fecha 11 de Abril del Año 2025, emitido por la Unidad de Servicios Legales de la SEDS. ACUERDA PRIMERO: CREAR el LICEO POLICIAL, como una dependencia del Sistema de Educación Policial/Dirección de Educación Policial (DEP) de la Dirección General de la Policía Nacional de Honduras (DGPN); con la finalidad de brindar a los hijos del personal de la Secretaría de Estado en el Despacho de Seguridad e hijos de los miembros de la Policía Nacional de Honduras activos y de los que fallecieron durante el servicio, una educación bilingüe de excelencia, basada en disciplina, valores y principios cívicos, formando ciudadanos íntegros con vocación de servicio y capacidad para contribuir al desarrollo de Honduras, en los Niveles de Educación Pre Básica, Básica y Media; en consonancia a la propuesta contenida en el ACTA DE SESIÓN DEL DIRECTORIO ESTRATÉGICO DE LA POLICÍA NACIONAL NÚMERO 037- 2025 y DICTAMEN TÉCNICO DGPN- DEP No.037-2025 de fecha 10 de abril del año 2025 y DICTAMEN LEGAL SEDS- USL-No.200-2025 de fecha 11 de Abril del Año 2025 donde se Dictaminó sobre la Procedencia de la Creación del “LICEO POLICIAL”. SEGUNDO: I N S T R U I R a l a G E R E N C I A ADMINISTRATIVA de la Secretaría de Estado en el Despacho de Seguridad para que a través de la Sub Gerencia de Presupuesto, IDENTIFIQUE y REALICE la Asignación Presupuestaria, para sufragar los gastos de funcionamiento y erogaciones generales del “LICEO POLICIAL”, para cada ejercicio fiscal, conforme a la Disponibilidad Presupuestaria asignada a la Secretaría de Estado en el Despacho de Seguridad y Policía Nacional de Honduras. TERCERO: Instruir al Sistema de Educación Policial/ Dirección de Educación Policial, realizar la Solicitud de Otorgamiento de Licencia de Operación y Acuerdo de Funcionamiento del “LICEO POLICIAL” ante la Secretaría de Estado en el Despacho de Educación. CUARTO: El presente Acuerdo es efectivo a partir de su publicación en el Diario Oficial “LA GACETA”. PUBLÍQUESE Y CÚMPLASE.
