This decree sets the fees charged by the Movable Guarantees Registry for its services, such as registrations, searches, and document copies. It affects individuals and businesses that need to register movable guarantees in Honduras, ensuring the registry has its own income to operate and continuously improve.

Considerations

Whereas, in accordance with Article 8 of Decree No. 82-2004 of May 28, 2004, containing the Property Law, which creates the Governing Board as the organ of decision and superior direction and Article 10 of the aforementioned Law, which confers powers and faculties upon the Governing Board, among which is the power to issue resolutions to regulate matters within its competence.

Whereas, through Article 4 of Decree 82-2004 of May 28, 2004, the Institute of Property is created as a Decentralized Entity of the Presidency of the Republic, granting it legal personality and its own assets, functioning with technical, administrative, and financial independence.

Whereas, through Legislative Decree No. 182-2009 dated August 24, 2009, containing the Secured Transactions Law, published in the Official Gazette La Gaceta No. 32,125 dated January 28, 2010, Article 28 of the Property Law was reformed, incorporating the Secured Transactions Registry as a registry of the Institute of Property administered by the Chamber of Commerce and Industries of Tegucigalpa.

Whereas, for the functioning of said registry it is essential to generate income that permits its self-sustainability and continuous improvement.

Whereas, the Secured Transactions Law did not establish the amounts that the Secured Transactions Registry shall charge for the services it provides.

Whereas, the powers that the Property Law in its Article 10, numeral 12 establishes that the Governing Board of the Institute of Property as the organ of decision and superior direction may set the values of the services it provides when these are not expressly designated in the applicable laws.
