This regulation establishes the maximum weight and dimension limits that all cargo vehicles must comply with when circulating in Honduras. The IHTT (Honduran Land Transportation Institute) is responsible for controlling and enforcing these standards through fixed and mobile weighing stations distributed at strategic highway locations. Drivers exceeding permitted limits will be sanctioned, and temporary special permits can be granted for indivisible or exceptional cargo under strict safety conditions.

Considerations

Whereas through Article 4 of the Land Transportation Law of Honduras, approved by Legislative Decree No. 153-2015, dated December 17, 2015 and published in "La Gaceta", Official Gazette of the Republic dated March 30, 2016, the Honduran Institute of Land Transportation (IHTT) was created as a Public Institution with its own budget and whose jurisdiction extends throughout the entire territory of the State.

Whereas Chapter II of the Land Transportation Law of Honduras, specifically Articles 37 through 44, regulates the Transport of Specialized and Non-Specialized Cargo, Hazardous Substances and Waste, and the Control of Weights and Dimensions, and Article 42 of this legal instrument establishes literally as follows: "....The Institute must implement systems of fixed scales or mobile scales or other types of technology for the control of weights and dimensions of vehicles intended for land transportation in its different modalities. The Regulations must establish the provisions for the implementation and control of this system......The Institute must include in the Regulations the necessary provisions to comply with what is established in this Article."

Whereas in compliance with the legal mandate held by the Honduran Institute of Land Transportation (IHTT), related to or cited in the preceding recital, on June 30, 2017, in the City of San Pedro Sula, the INTER-INSTITUTIONAL COOPERATION AGREEMENT FOR THE ESTABLISHMENT OF A SYSTEM OF WEIGHTS AND DIMENSIONS BY MEANS OF SCALES AT DIFFERENT PRIORITY POINTS ON THE HIGHWAYS OF HONDURAS, EXECUTED BETWEEN THE HONDURAN INSTITUTE OF LAND TRANSPORTATION (IHTT) AND LEGAL REPRESENTATIVES OF THE ASSOCIATION OF NORTHWESTERN PETROLEUM TRANSPORTERS (ATRAPENO) AND CHAMBER OF CARGO TRANSPORTATION OF HONDURAS (CATRACHO), IMPORTANT PARTS OF THE ORGANIZED SECTOR OF PUBLIC CARGO TRANSPORTATION IN THE COUNTRY, was executed and entered into force, through which the terms, conditions and characteristics of the design, construction, installation and operation of a first stage of rapid installation and operation of Scales or Mobile Weighing Equipment were agreed upon, principally at the following points of national territory: Jícaro Galán; San Lorenzo; Cerro de Hula; Comayagua; Talanga; Danlí; Colón; Detour to Ceibita near Lake Yojoa; Detour to La Esperanza, exit to Highway CA-5; La Entrada, Copán; Highway to Puerto Cortés; and Highway to Corinto. It was further agreed that the implementation shall be progressive at these locations of that first stage of rapid installation and operation of Scales or Mobile Weighing Equipment and, should it not be possible to implement due to financial incapacity, limitation or insufficiency at one or more of these locations, the parties may withdraw from such location or locations without any resulting liability.

Whereas in Chapter Four of that Agreement the following was established literally: "FOURTH: For all purposes derived from this Agreement and those corresponding hereinafter, the Honduran Institute of Land Transportation (IHTT) as the new land transportation authority of the Country, prior to the commencement of this first stage of rapid installation and operation of Scales or Mobile Weighing Equipment, shall put into effect the new SPECIAL REGULATION OF WEIGHTS AND DIMENSIONS, to make effective the entire process and operability of the system of this first stage and the subsequent stages that are implemented." And, by virtue of all that is related and cited, the aforementioned Agreement is a fundamental part of this Special Regulation.

Whereas the Honduran Institute of Land Transportation (IHTT), exercising its legal authority to issue regulations in matters of transportation, in accordance with Numeral 9 of Article 11 of the Land Transportation Law of Honduras and, specifically exercising the legal authority to regulate the control of weights and dimensions in Honduras and to implement systems of fixed scales and mobile scales or other types of technology for such purposes (Such as but not limited to, High-Speed Dynamic Vehicle Weighing Systems), established clearly and expressly in Article 42 of the Land Transportation Law in Honduras, hereby includes in this Administrative Act the SPECIAL REGULATION OF THE NATIONAL SYSTEM FOR THE CONTROL OF WEIGHTS AND DIMENSIONS IN HONDURAS, so that it be in turn published in "La Gaceta", Official Gazette of the Republic and adopt the character of effective and mandatory compliance.

Whereas Numeral 2 of Article 118 of the General Law of Public Administration establishes clearly and expressly that acts of a general character issued in the exercise of regulatory authority shall be issued by Executive Agreement, and furthermore, Numeral 4 of Article 119 of the General Law of Public Administration establishes clearly and expressly that organs such as the Honduran Institute of Land Transportation (IHTT) may issue Executive Agreements such as the present one, as well as the President of the Republic and the Secretaries of State; consequently, this Administrative Act is issued in compliance with all the legal and administrative support required.

Whereas the Honduran Institute of Land Transportation (IHTT) as a new state institution bears a historic responsibility and it becomes incumbent that all of its regulations respond unavoidably to the more than justified aspirations of the Honduran people and particularly of the transportation sector of the Country, to guarantee that in its internal and external functioning the corruption that has historically affected this so important and promising sector of Honduras is completely eliminated; for this reason, henceforth, legality, transparency, propriety, modernization, updating, efficiency, quality and other values shall be permanent and imperative in the provision of all services that this Public Institution provides.
