- Decree: 134-2016
- Published: November 15, 2016
- Issuing body: Congreso Nacional
- Gazette: 34,187
- Category: Financial & Tax
Summary
This decree eliminates the 200 lempira fee that people had to pay to replace their Identity Card, especially benefiting vulnerable groups such as the unemployed, elderly, and students. The measure applies from publication until December 31, 2017, and the State allocates 39 million lempiras to compensate the National Registry of Persons for expenses.
Considerations
Whereas it is incumbent upon the State, by constitutional mandate, to promote the well-being of citizens in the social, civic, and economic activities that they conduct daily.
Whereas in application of Decree 17-2010 dated March 28, 2010, containing the Law for Strengthening Income, Social Equity and Rationalization of Public Expenditure, as reformed by Decree 146-2014, dated August 22, 2015, it establishes in Article 49 thereof, the charging of a fee of TWO HUNDRED LEMPIRAS (L. 200.00) for the replacement of Identity Cards.
Whereas many persons lose their personal identification documents as a result of theft, robbery, and other causes, as well as due to the deterioration of the plastic card. That persons from vulnerable groups such as: low-income individuals, the unemployed, elderly adults, and students would find in the payment for Identity Card replacement an inconvenience that would affect the exercise of their freedoms and rights.
Whereas in accordance with Article 205 Attribution 1) of the Constitution of the Republic, it is incumbent upon the National Congress to create, enact, reform, and interpret laws.
