This law creates a regulation for the Special Protection Unit that defends judges, magistrates, and public defenders of the Judicial Power against threats, intimidation, and violence arising from their work. It establishes principles such as confidentiality, voluntariness, and free services, as well as procedures to assess risks and provide personalized security measures based on the level of danger they face.

Considerations

That in accordance with what is established in article 1 of our Political Constitution, Honduras is a State of Law, sovereign, constituted as a free, democratic and independent Republic, to ensure to its inhabitants the enjoyment of justice, freedom, culture and economic and social well-being.

That article 59 of the Constitution of the Republic provides that the human person is the supreme purpose of society and the State.

That based on article 303 of the Constitution, the power to administer justice emanates from the People and is administered free of charge in the name of the State, by independent Judges and Magistrates, subject only to the Constitution and the laws.

That article 307 of the Constitution mandates that the Law, without prejudice to the independence of judges and magistrates, shall provide what is necessary in order to ensure the correct and normal functioning of the courts of justice, providing effective means to meet their functional and administrative needs, as well as the organization of auxiliary services.

That the Inter-American Court of Human Rights recognizes the fundamental role of State officials who perform essential functions for the respect and guarantee of Human Rights. From this perspective, judges are contemplated, to whom primarily belongs the jurisdictional function, as well as public defenders who, from their respective roles, are linked to the proceedings in which the State performs functions aimed at guaranteeing access to justice and due process as cornerstones of the Democratic and Rule of Law State.

That the State of Honduras has the obligation to protect Justice Operators from attacks, acts of intimidation, threats and harassment, investigating those who commit violations against their rights and effectively sanctioning them. In this sense, the Plenary of the Supreme Court of Justice states that necessary actions must be carried out, in conjunction with other State instances responsible for public security, to guarantee the security of its justice operators against all kinds of external pressures, including reprisals directly aimed at attacking their person and family, a situation that can affect the jurisdictional function and access to justice.

That the National Plan of Action on Human Rights of the Republic of Honduras commits the obligation of the State to reduce to zero violations of the right to life of human rights defenders, social communicators and justice operators, for which the creation of a Special Law is mandated that adopts measures for the security of persons and groups in situations of vulnerability or exposed to specific situations of risk for human rights defenders, journalists, social communicators and justice operators.

That the International Conventional and Jurisprudential standards consider that the protection of the life and integrity of Justice Operators is an obligation of the State and an essential condition to guarantee due process and judicial protection. In particular, the Inter-American Court of Human Rights has stated that "the State must guarantee that judicial officials, prosecutors, investigators and other justice operators have an adequate security and protection system, taking into account the circumstances of the cases under their charge and the place where they are working, which allows them to perform their functions with due diligence."

That the United Nations Basic Principles relating to the Independence of the Judiciary provide that judges shall resolve the matters before them with impartiality, based on the facts and in accordance with the law, without any restriction and without influences, inducements, pressures, threats or improper interference, whether direct or indirect, from any sector or for any reason. In the same sense, the United Nations Human Rights Committee has stated that it is necessary to protect judges against conflicts of interest and intimidation. To that end, the law must adequately guarantee the security of judges and States must establish actions to guarantee the physical protection of judges and their families at all times.

That the Inter-American Commission on Human Rights of the Organization of American States in its reports on Honduras has expressed its concern about acts of violence against Justice Operators and the situation of insecurity and absence of adequate protection measures for them and their families in the face of threats and risks derived from the work they perform. In this sense, it has recommended to the State to establish specific protection mechanisms for Justice Operators and their relatives and to implement actions that materialize the special duty of protection so that they can carry out their work of fighting impunity, without becoming victims of the very cases they investigate or resolve.

That the Universal Periodic Review Mechanism of the United Nations Human Rights Council approved various recommendations to the State of Honduras related to the situation of protection of judges and magistrates, urging the State to adopt an effective prevention and protection policy to guarantee the right to life, integrity and security of Justice Operators.

That through Legislative Decree No. 34-2015 dated April 16, 2015, published in the Official Gazette La Gaceta No. 33,730 dated May fifteenth (15) of the year two thousand fifteen (2015), the Law for the Protection of Human Rights Defenders, Journalists, Social Communicators and Justice Operators and its Regulation of August 16, 2016 was issued, which defines in its Article 5 Justice Operators as "the officials or employees who participate in the process of application or administration of the Law such as police, prosecutors of the Public Ministry, judges and magistrates of the Judicial Branch and lawyers in the exercise of the defense work they perform in the exercise of their profession".

That the Law for the Protection of Human Rights Defenders, Journalists, Social Communicators and Justice Operators establishes in its Article 64 the obligation for justice sector institutions to progressively organize a protection mechanism for judges, magistrates, public defenders and prosecutors, in accordance with the principles, risk analysis and standards established in the aforementioned Law and its Regulation mandates in its Article 73 that the Coordination of the National Council prioritize the necessary actions so that the Judicial Branch and the Public Ministry progressively organize a Protection Mechanism for Judges, Magistrates, Public Defenders and Prosecutors within a period of six (6) months following the approval of the Regulation.

That the Law for Special Protection of Officials and former officials in extraordinary risk - Decree 323-2013 - considers that there are high-ranking officials of the State and Justice Operators who, as a direct consequence of their actions and decisions inherent to their office, are exposed to extraordinary risks and real threats and for this reason the protection of the State is necessary in the performance of their functions and in certain cases after having ceased the same.

That in accordance with Agreement No. PCSJ 12-2018, the Special Protection Unit for Judges, Magistrates and Public Defenders is created, which as a technical support body will be responsible for managing the implementation of the special protection mechanism for justice operators assigned to the Judicial Branch.

That, with the repeal of the Law of the Council of the Judiciary and Judicial Career, as a result of its declaration of unconstitutionality, the Law of the Judicial Career, its Regulation and the Internal Regulation of the Council of the Judicial Career have returned to full force, as well as the transitory article 3 of Legislative Decree No. 282-2010, ratified through Legislative Decree No. 5-2011, which provides that, while the Council of the Judiciary and Judicial Career is being installed, the President or Chairwoman of the Supreme Court of Justice shall have the powers to: 1) select, appoint and remove Judges, Magistrates and other jurisdictional and administrative personnel, in accordance with what is established in the Law; and, 2) organize and administratively direct the Judicial Branch.

That the Internal Regulation of the Supreme Court of Justice empowers in its Article 15 its President or Chairwoman, among other powers to: a) Preside over the Supreme Court of Justice and represent the Judicial Branch in official and public acts; and perform the administrative function of the Judicial Branch in accordance with the Constitution of the Republic and other Laws.

As a result of the foregoing, judges are recognized as controllers of the constitutionality and legality of acts of other branches of the State, as well as administrators of justice in a democratic society. Public defenders, for their part, perform an essential role to ensure that the State complies with its obligation to guarantee due process to persons who may be affected by the exercise of the State's punitive power.

It is constructed based on two dimensions: the threat, referring to the explicit nature evident and causative of the event and vulnerability, of an intrinsic, specific and particular nature of the judicial operator, that damage or harm is inflicted upon them. • 12)

      That the risk be clear and discernible;

    • g)

      That the risk be exceptional, when it is a situation that should not be endured by anyone;

    • h)

The General Coordination must notify the resolution to the petitioning persons through the Case Reception Office, which shall transfer it to the Risk Analysis Office so that it may prepare the Risk Assessment Study that shall be presented to the Technical Committee, taking into account the deadlines defined in the Protection Law for Human Rights Defenders, Journalists, Social Communicators and Justice Operators, and in accordance with the following:

  • 1)

    In those cases in which urgent protection measures must be implemented, the General Coordination must issue the corresponding resolution immediately and through the Case Reception Office shall immediately implement the temporary measures determined with the consent of the petitioner;

  • 2)

    In those circumstances in which the General Coordination issues urgent protection measures and in the absence of information for the preparation of the Risk Assessment Study, the Technical Committee shall order the continuity of the temporary protection measures, until the Study is obtained;

  • 3)

    Against urgent protection measures, the decisions that are ordered by the General Coordination in these cases are mandatory and timely compliance by the entities in charge of their implementation, who shall always act under the principles and criteria established in this Regulation. These must attend to such cases as a priority;

  • 4)

    It shall not be permitted for either the Special Protection Unit or those in charge of implementing urgent protection measures to claim absence of capacities, procedural reasons or defects in the procedure, and must act under the criteria of interpretation and the pro persona principle. CHAPTER III MEASURES ORDERED BY THE TECHNICAL COMMITTEE.

Article 28.-

The Technical Committee in accordance with its authority to evaluate protection measures may determine their granting; their denial of granting; suspension; modification; continuity or non-resolution for the purpose of requesting the review and supplementation of information necessary for decision-making regarding Risk Assessment Studies.

Article 29.-

In accordance with the requests presented to the General Coordination by the beneficiary persons or their representatives to be incorporated into the Special Protection Unit or to expand, modify, suspend and/or cancel protection measures, in cases under extraordinary proceedings, once the request is received, and always with the consultation and consent of the beneficiary persons, the Office of Risk Analysis and Implementation of Preventive and Protection Measures shall proceed immediately to prepare the Risk Evaluation Studies that will allow the Technical Committee to make the decision.

Article 30.-

The Office of Risk Analysis and Implementation of Preventive and Protection Measures, once the protection measures ordered by the Technical Committee are issued, shall notify within a period not exceeding forty-eight (48) hours the person or group of beneficiary persons and/or their representative, and shall inform them of the remedies available against such measures if applicable. In the same manner, said Unit, within the same period shall notify the instances and departments responsible for the implementation of the corresponding measures. CHAPTER IV RISK EVALUATION STUDY

Article 31.-

The Office of Risk Analysis and Implementation of Preventive and Protection Measures is the specialized technical body responsible for preparing Risk Evaluation Studies for Justice Operators or their groups that request protection before the Unit. In fulfillment of this function, the following principles shall be taken into account:

  • 1)

    For all cases related to the risk evaluation study, the consent of the beneficiary persons must be taken into account, their participation shall be guaranteed through interviews and they shall be consulted on the final determination of the Risk Evaluation Study, prior to its presentation before the Technical Committee; likewise, their participation in the deliberation of their case shall be guaranteed.

  • 2)

    All Risk Evaluation Studies shall be governed by the following criteria:

    • a)

      Independence;

    • b)

      Objectivity;

    • c)

      Confidentiality.

  • 3)

    In cases where lack of objectivity, conflict of interest, or irregularities in the procedure are observed, the Technical Committee may order the General Coordination to conduct a new risk evaluation study, which shall be carried out by a different analyst than the one who conducted the risk evaluation in question.

Article 32.-

Based on the inputs presented by the Office of Risk Analysis and Implementation of Preventive and Protection Measures, the Technical Committee shall conduct the study, determine and order prevention and protection measures, complying with the deadlines set forth in these Regulations.

Article 33.-

The persons and institutions that make up the Technical Committee shall attend on a priority basis to requests for information made by the Office of Risk Analysis and Implementation of Preventive and Protection Measures, in order to facilitate the information that allows them to carry out their work.

Article 34.-

In the absence of information to conduct the risk evaluation study, the Technical Committee shall under no circumstance be able to make a determination in this regard.

Article 35.-

To conduct the Risk Evaluation Study and determine preventive or protection measures, the Technical Committee shall take into account that the objective of such analysis is:

  • 1)

    To identify the risk that hangs over a person, a family or a group of persons belonging to the population protected by these Regulations, as well as to warn promptly and clearly about its existence to those affected. The above implies that the Special Protection Unit, in addition to acting on requests for protection, must deploy all actions to act ex officio and preventively in the identification and attention of risk.

  • 2)

    To assess, based on a careful study, the characteristics of the risk and the origin or source of the threat;

  • 3)

    To timely define the specific, appropriate and sufficient prevention and protection measures and means to prevent the risk from materializing;

  • 4)

    To assign measures in a timely manner and in a manner adjusted to the circumstances of each case, in such a way that the protection is effective;

  • 5)

    To periodically evaluate the evolution of the risk and make the corresponding decisions to respond to such evolution;

  • 6)

    For the imposition of measures, it is sufficient to invoke or summarily prove the facts that point to the existence of a risk, always keeping in mind the principle of good faith, the vulnerability or special exposure to risk in which Justice Operators who are beneficiaries of the Special Protection Unit find themselves.

  • 7)

    The Risk Evaluation Study may issue conclusions and recommendations for protection measures which must take into account the context and the specific circumstances in which the risk and the protection needs of the beneficiary persons are presented. CHAPTER V GENERAL CONSIDERATIONS FOR THE GRANTING OF MEASURES

Article 36.-

For all purposes related to the determination and implementation of Prevention and Protection Measures, the following must be observed:

  • 2)

Article 38.-

In the resolutions of preventive and protection measures issued by the Technical Committee, the officials in charge of implementation shall always be informed that their omission, negligence or non-compliance will result in sanctions and in which case action shall be taken in accordance with the procedure established in these Regulations or, failing that, in the one established in the Regulations of the Protection Law for the sanction procedure.

Article 42.-

MEASURES REGARDING THE EXISTENCE OF EXTENSIVE RISK. The preventive and protection measures for the family nucleus of the beneficiary person shall be determined based on the Risk Evaluation Study carried out, for which purpose it shall be established whether the risk extends to the spouse, common-law spouse, ascendants, descendants, and dependents of the beneficiary persons; the same criterion shall apply with respect to persons who are part of the work teams of the Justice Operator, or who participate in associations, organizations, or collectives.

Article 45.-

REVIEW AND SUSPENSION OF MEASURES. The beneficiary person may at any time approach the Technical Committee to request a review of the Prevention and Protection measures.

  • 1)

COMMUNICATE. ROLANDO EDGARDO ARGUETA PÉREZ PRESIDENT LUCILA CRUZ MENÉNDEZ GENERAL SECRETARY

Supreme Court of Justice TRANSCRIPTION OF AUTO ACORDADO The undersigned, General Secretary of the Supreme Court of Justice, TRANSCRIBES the Auto Acordado that was approved in Point No. 9 of Minutes No. 31-2018 of the Session held on the eighth of November of the year two thousand eighteen, with the presence of the Judges and Magistrates: ROLANDO EDGARDO ARGUETA PÉREZ, LIDIA ÁLVAREZ SAGASTUME, JOSÉ OLIVIO RODRÍGUEZ VÁSQUEZ, JORGE ALBERTO ZELAYA ZALDAÑA, RAFAEL BUSTILLO ROMERO, EDGARDO CÁCERES CASTELLANOS, WILFREDO MÉNDEZ ROMERO, RINA AUXILIADORA ALVARADO MORENO, EDWIN FRANCISCO ORTEZ CRUZ, REINA AUXILIADORA HÉRCULES ROSA, JORGE ABILIO SERRANO VILLANUEVA AND ALMA CONSUELO GUZMÁN GARCÍA AND AS MAGISTRATES MEMBERS: JILMAN RODOLFO NOLASCO INESTROZA, CONAN RAFAEL ARGUETA BOURDETT AND NERY MAURICIO MIRANDA SANABRIA BY JUSTIFIED ABSENCE OF THE MAGISTRATES: REYNALDO ANTONIO HERNÁNDEZ, MIGUEL ALBERTO PINEDA VALLE AND MARÍA FERNANDA CASTRO MENDOZA and which literally says: AUTO ACORDADO CONSIDERING (1): By virtue of the repeated complaints that the Civil Chamber has received from the General Prosecutor's Office of the Republic, consisting of the fact that several judges in civil matters are requiring the personal appearance of the holder of the General Prosecutor's Office of the Republic, in the different hearings of the civil proceedings in which the State of Honduras is a party; and due to their non-attendance they resolve to consider it as non-appearance, although the procedural representative delegated by said entity is accredited, a situation that violates the conventional and constitutional guarantees that regulate due process, forgetting that the probity of the legislator is clarity, in the same way the courtesy of justice is speed. CONSIDERING (2): In accordance with what was stated by the United Nations Organization, the rule of law can be defined as "a principle of governance in which all persons, institutions and entities, public and private, including the State itself, are subject to laws that are promulgated publicly, enforced equally and applied independently, in addition to being compatible with international standards and principles of human rights. It also requires that measures be adopted to ensure respect for the principles of rule of law, equality before the law, separation of powers, participation in decision-making, legality, non-arbitrariness and procedural and legal transparency". CONSIDERING (3): In accordance with what is established by the Constitution of the Republic, the form of government of Honduras is republican, democratic and representative. It is exercised by three powers; Legislative, Executive and Judicial, complementary and

independent and without relationships of subordination (article 4 of the Constitution of the Republic). The General Prosecutor and Sub-Prosecutor of the Republic are appointed by the National Congress of the Republic in respect to the form of inter-institutional government, but they are not the State, only its defender, therefore, the General Prosecutor's Office of the Republic has the legal representation of the State; and its organization and operation shall be determined by Law (article 228 Constitution of the Republic). For the foregoing the General Prosecutor of the Republic IS NOT A PARTY to the process, he merely holds the LEGAL REPRESENTATION OF THE STATE, in this case, in judicial matters. CONSIDERING (4): A party to proceedings is defined as the natural or legal person who intervenes in judicial proceedings, the one who sues and against whom suit is brought. Or in other words, whoever requests judicial protection and against whom it is requested; and as a material party those subjects who hold the ownership of the rights or interests to whose satisfaction the process is directed, and those who hold the obligations or duties corresponding to those rights. CONSIDERING (5): Articles 445.1, 446.3, 590, 591 of the Civil Procedural Code, among others, establish the procedural effects of non-appearance of the material party to a hearing in the process and understanding that the State is a public legal entity, in accordance with what is provided in the same procedural law article 62 literal c) already provides that for public legal entities… those who legally represent them shall appear, in which the legal situation of the General Prosecutor's Office of the Republic would be understood, who based on its organic law can delegate the power to act in litigation in accordance with what is prescribed in article 82.2 of the Civil Procedural Code, thereby supplementing the appearance of the holder of the General Prosecutor's Office of the Republic. CONSIDERING (6): According to what is provided in article 19 of the Organic Law of the General Prosecutor's Office of the Republic, the Prosecutor section shall be responsible for the representation of the State and shall be exercised by the General Prosecutor of the Republic who shall have, among others, the following powers: 1st. To promote, represent and sustain the rights of the State in all trials in which it is a party. In these cases he shall have the powers of a general attorney, but shall require express authorization from the Executive Power, provided by agreement, in each case to exercise the powers designated in the second paragraph of Article 8 of the Code of Procedures (understood currently article 82 of the Civil Procedural Code). That is, for the express power to reconcile, there must have been a prior executive agreement to exercise said function. 2nd. To raise the pertinent remedies against unfavorable resolutions in whole or in part, to the interests he represents in exercise of that same representation. The Prosecutor is obligated to appear at the proceeding to answer interrogatories, when expressly given that power.

3rd. To appear in representation of the State, in accordance with the instructions of the Executive Power and the granting of acts or contracts in which the nation was interested. 4th… 5th… 6th… 7th… 8th… 9th… 10th… 11th. To watch over the prompt and proper administration of justice by formulating appropriate observations to the Supreme Court of Justice, demanding compliance with the laws and requesting the Execution of Sentence in Matters in which he participated. 12th. To assume, when he deems it appropriate, temporary or definitive representation in trials or proceedings in which the officials under his jurisdiction participated. 15th…. CONSIDERING (7): According to the cited powers of the holder of the General Prosecutor's Office of the Republic, in his general power he does not hold the power to reconcile, which is what requires the presence of the material party, since to dispose of it he needs an executive agreement and being reconciliation a voluntary act, his non-appearance should not be an obstacle to the development of the process and should not render nugatory the right of defense that assists the State as a party. CONSIDERING (8): The General Prosecutor's Office of the Republic shall function through the sections of Prosecution, Prosecution and Consulting that shall be headed by the Agents designated by the Prosecutor, having to substitute one another in accordance with his determination in cases of absence, temporary lack or legitimate impediment. (Article 16). Understanding that legitimate impediment is that the General Prosecutor cannot be omnipresent throughout the country, in all trials and in all hearings. CONSIDERING (9): That, for the better administration of justice, the Supreme Court of Justice may issue autos acordados, which are regulatory provisions of a general nature, aimed at the exact fulfillment of the legal provisions in force regarding justice. THEREFORE, in view of the foregoing considerations, this Supreme Court, AGREES: FIRST: TO INSTRUCT the Courts and Tribunals of the Republic with jurisdiction in civil matters that in the different hearings of the proceedings, the presence of the State of Honduras as a party in the process, must be considered as having appeared through the legal professional duly accredited by the General Prosecutor's Office of the Republic in accordance with the provisions of article 19.1 of the Organic Law of the General Prosecutor's Office of the Republic in accordance with article 82 of the Civil Procedural Code, without prejudice to the guarantee of defense contained in article 82 of the Constitution of the Republic. SECOND: This auto acordado containing this provision shall be effective from its publication in the Official Gazette La Gaceta. Tegucigalpa, M.D.C., November 22, 2018.
