Summary
This law creates a special program by the Public Ministry that protects witnesses in criminal trials who face danger because of their testimony. It offers measures such as relocation, identity change, police protection, and work benefits, free of charge and confidentially. It also protects family members and associates of the witness who are in danger.
Considerations
Whereas the human person is the supreme purpose of society and the State, and all of us have the obligation to respect and protect him or her.
Whereas the Constitution of the Republic guarantees to Hondurans and foreigners residing in the country, the right to the inviolability of life and individual security.
Whereas the collaboration of citizens with the administration of justice is relevant and necessary to avoid impunity and guarantee a correct application of the Laws; which makes unavoidable the creation of norms regarding the protection of witnesses in criminal proceedings.
Whereas the Program for the Protection of Witnesses in Criminal Proceedings is a necessary instrument for the effectiveness of the administration of justice.
Whereas the Palermo Convention approved by Decree No. 108-2003 dated July 22, 2003, obligates the States Parties to adopt appropriate measures within their possibilities to effectively protect witnesses, among other participants in criminal proceedings.
Whereas although articles 5, 237, and 248 of the Criminal Procedure Code provide certain protective measures for witnesses, experts, and other participants in Criminal Proceedings, these prove to be insufficient, which is why it is necessary to complement them by creating a Special Program for the Protection of Witnesses.
Whereas it is the responsibility of the National Congress to create, decree, interpret, reform, and repeal laws.
