Summary
This resolution temporarily appoints Johel Antonio Zelaya Álvarez as Attorney General of the Republic and Mario Alexis Morazán Aguilera as Deputy Attorney General. These positions are interim until the full National Congress elects the permanent officials, thus fulfilling the obligation to fill these vacant positions in the Public Prosecutor's Office.
Considerations
Whereas, in accordance with Article 207 of the Constitution of the Republic, "The Directorate of the National Congress, before closing its sessions, shall designate from its members nine (9) principal members and their respective alternates who shall form the Permanent Commission during the recess of the National Congress".-
Whereas, in accordance with Article 25 of the Organic Law of the Legislative Branch, the Permanent Commission is the organ of the National Congress that, during its recesses, exercises the functions and powers designated to it by the Constitution of the Republic and this Law.-
Whereas, on the thirty-first (31st) day of October in the year 2023, by means of Resolution 03-2023, the Board of Directors of the National Congress appointed the Permanent Commission of the National Congress.-
Whereas, according to the Constitution of the Republic in its Article 208, numeral 11, one of the powers of the Permanent Commission of the National Congress is to "Elect temporarily, in case of absolute vacancy, the substitutes of the officials who must be designated by the National Congress".-
Whereas, the Constitution of the Republic establishes in its Article 232 that "The Public Ministry is the specialized professional body, responsible for the presentation, defense and protection of the defense and protection of the interests of society, functionally independent of the Powers of the State and free from all political sectarian interference…".-
Whereas, Article 23 of the Organic Law of the Public Ministry establishes that "The General Prosecutor of the Republic and the Assistant General Prosecutor shall serve in their functions for five (5) years, and may be re-elected only for one new period." Thus clearly establishing with this that there exists an absolute vacancy of the heads of the Public Ministry.-
Whereas, the timely election of the General Prosecutor of the Republic and the Assistant General Prosecutor is an urgent and necessary legislative obligation to efficiently manage the fight against corruption, impunity, the proliferation of organized crime, and the construction and consolidation of democracy and the Rule of Law.
