Considerations

Whereas in accordance with Article 59 of the Constitution of the Republic: "The human person is the supreme purpose of society and the State. All have the obligation to respect and protect it".

Whereas Article 245 of the Constitution of the Republic of Honduras in its numeral 11 establishes that: "It is an attribution of the President of the Republic to issue agreements and decrees and to issue regulations and resolutions in accordance with the Law".

Whereas Article 4, as amended, of the General Law of Public Administration, through Legislative Decree No. 266-2013, dated December 16, 2013, published in the Official Newspaper "La Gaceta" on January 23, 2014, establishes that the creation, modification, or suspension of State Secretariats or Deconcentrated Organisms or Entities can only be made by the President of the Republic in Council of State Secretaries.

Whereas Article 11 of the General Law of Public Administration establishes that the President of the Republic is responsible for the supreme direction and coordination of centralized and decentralized Public Administration and that the President of the Republic, in the exercise of his functions, may act alone or in Council of Ministers.

Whereas in accordance with Article 14, as amended, of the aforementioned Law, the President of the Republic, by Decree in Council of State Secretaries, may issue within the Centralized Administration the norms required to determine, among others, the jurisdiction of the Offices by the State Secretariats and create the internal dependencies that may be necessary for good administration; and, reorganize those that the efficiency of Public Administration demands.

Whereas through Legislative Decree No. 266-2013, dated December 16, 2013, published in the Official Newspaper "La Gaceta" on January 23, 2014, the General Law of Public Administration was amended, modifying, among others, Articles 28 and 29 that refer to the State Secretariats that comprise the Executive Branch, reorganizing their jurisdiction, establishing the Secretariat of Human Rights, Justice, Interior Affairs and Decentralization, to which were assigned the jurisdiction of the Secretariat of the Interior and Population and the Secretariat of Justice and Human Rights.

Whereas through Executive Decree Number PCM-001-2014, dated February 3, 2014 and published in the Official Newspaper "La Gaceta" on February 22, 2014, in its Article 2, the Sectorial Cabinet of Governance and Decentralization was created, integrating among others, the State Secretariat in the Offices of Human Rights, Justice, Interior Affairs and Decentralization. It equally established that the administrative structures, personnel and budget of the former State Secretariat of Justice and Human Rights are transferred to the State Secretariat of Human Rights, Justice, Interior Affairs and Decentralization.

Whereas Honduras as a State Party to International Agreements of the Universal System and the Inter-American System for the Protection of Human Rights, is obligated to respect, protect, guarantee and promote human rights.

Whereas to strengthen the promotion and protection of Human Rights, it is deemed appropriate to establish a specialized body within the Executive Branch whose purpose is the promotion, protection and guarantee of Human Rights, in order to provide continuity, compliance and updating to the Public Policy and National Plan of Action in Human Rights, as well as to provide technical advice to the different state bodies to achieve efficient performance of Public Administration, with strict observance and compliance with the State's obligations in this matter.

Whereas to make the performance of jurisdiction in matters of Governance, Justice and Decentralization efficient and to make public management more effective, it is appropriate to reorganize and restructure the current State Secretariat of Human Rights, Justice, Interior Affairs and Decentralization, separating the Human Rights portfolio and creating a new State Secretariat that addresses national objectives in this important matter.
