Non-compliance with these provisions constitutes a Very Serious offense, which must be communicated to the competent body so that the respective disciplinary proceeding is initiated.
SUSPENSION BY FORMAL CHARGE ORDER. In accordance with article 61 of THE LAW, when a member of the Police Career has been issued a Formal Charge Order for a willful offense, they shall be immediately suspended from their position without salary, said suspension must operate automatically, as soon as knowledge is obtained of the imputation of said formal charge order and does not require any formality, except that these actions are derived from service or there are indications of legitimate self-defense, act of God, or force majeure. In case of a Final Convicting Sentence, the appropriate course of action is the termination of the Police Career through the cancellation of the Appointment Agreement without liability for the State, in accordance with what is established in article 116 of this regulation. Except that these actions are derived from service or there are indications of legitimate self-defense, act of God, or force majeure. A record of all of the foregoing must be made in the personnel file or record sheet. Non-compliance with this provision by the responsible official shall result in the corresponding administrative, civil, and penal liability. Excluded from the suspension measure established in this article are cases derived from the legitimate exercise of their position in the police service.
SUSPENSION BY DISCIPLINARY PROCEDURE. Suspension by disciplinary process is the administrative act through which a member of the Police Career is suspended from their functions due to a disciplinary process for Very Serious Infractions, for which they shall be assigned the performance of tasks that do not interfere with the disciplinary investigation; or they are suspended from their position and functions, for the period and under the terms established in the Disciplinary Regulation. DISCIPLINARY REGIME. The disciplinary regime provided in the ORGANIC LAW and in the Law of the Police Career establishes the norms and general disciplinary procedures with the purpose of regulating, preventing, investigating, and sanctioning infractions committed by members of the police career; without prejudice to the penal, civil, or administrative liability that corresponds.
