Considerations
Whereas the Constitution of the Republic establishes: The right to life is inviolable, the human person is the supreme end of society and of the State, and all have the obligation to respect and protect it.
Whereas Article 85 of our Constitution stipulates that no person may be detained or imprisoned except in places determined by Law.
Whereas prisons are establishments of security and social defense, and in them the rehabilitation of the individual and their preparation for work shall be sought.
Whereas the Minimum Standard Rules for the Treatment of Prisoners adopted by the United Nations in 1948 establishes, among others: "Order and discipline shall be maintained firmly, but without imposing more restrictions than are necessary to maintain the same and good organization of life in common."
Whereas it is the responsibility of the Secretaría de Estado en el Despacho de Seguridad Interior to formulate programs, plans, projects and strategies within the framework of approved policy, as well as to coordinate, direct and administer the National Police.
Whereas it corresponds to the Secretaría de Estado en el Despacho de Seguridad to direct and coordinate the various departments and services as provided in the Organic Law of the National Police of Honduras, the Regulations, Manuals and Instructions created for such purpose; it likewise has the responsibility to administer, control and oversee the Penitentiary System of the Country.
Whereas this Regulation has the purpose of regulating the applicable rules to the National Penitentiary System, particularly the Organic Law of the National Police in accordance with what is established in Article 165 of said Law.
Whereas the draft General Regulation of the National Penitentiary System was submitted for opinion to the Office of the Attorney General of the Republic, in accordance with what is established in Article 41 of the Administrative Procedure Law and Article 165 of the Organic Law of the National Police of Honduras.
Whereas it corresponds to the President of the Republic, among other powers, to direct the general policy of the State, to represent it, to administer the public treasury and to issue extraordinary measures in economic and financial matters when so required by the national interest.
Whereas the President of the Republic is in charge of the state enterprise and coordination of the centralized and decentralized Public Administration, the General Administration of the State and therefore to direct the economic and financial policy thereof, being able to act by himself or in Council of Ministers.
Whereas it is a constitutional duty of the State to ensure the health of the Honduran people. Whereas health is considered as a state of integral well-being, biological, psychological, social and ecological, is a right of every person and corresponds to the State its protection, recovery and rehabilitation through its health service production units.
Whereas the protection, promotion, prevention, preservation, restitution and rehabilitation of the health of the population are fundamental priorities of the Government of the Republic, as well as the establishment of the bases to simplify and rationalize administrative procedures in order to ensure that all actions are carried out in compliance with the law, achieving the prompt and effective satisfaction of interested parties.
Whereas the Government of Spain through the Spanish Agency for International Development Cooperation (AECID) signed with the Government of Honduras, through the Secretaría de Estado en el Despacho de Salud of the previous Public Administration, a Memorandum of Understanding regarding the Action Plan of the Strategy for Reduction of Maternal and Child Mortality (RAMNI). The general objective of RAMNI is to achieve by 2015 a reduction in maternal and child mortality rates which have historically been very high in Honduras. Now, the Budget Execution Program in the Secretaría de Salud during the present fiscal year must be operationalized considering that there are strategies that must be coordinated from the central level to health services in the different localities, with a perspective of harmonization among the various initiatives of the actors, institutions involved and international cooperation agencies.
Whereas among the national health institutes, the Instituto Nacional de Geriatría (ING) has been classified as a specialized institution destined to provide comprehensive quality geriatric care to the elderly population of the country with preventive, curative, rehabilitative services and health promotion within the framework of national policies.
