Summary
This law establishes mandatory standards that all public, community, and private schools in Honduras must meet for construction and operation. The Education Ministry must inspect and certify that schools comply with these standards and can close those that do not.
Considerations
Whereas the Constitution of the Republic establishes in its Article 59, that the human person is the supreme purpose of society and of the State, and that all have the obligation to perform and protect, for the achievement of their full realization with secure assurance within the framework of declarations of rights and guarantees, in Constitutional Article 119 "the special protection by the State of children, noting that these laws are of public order".
Whereas in the Code of Childhood and Adolescence, contained in Decree 73-96, dated May 30, 1996, the scheme of comprehensive protection of the rights of children and adolescents is defined, specifying the scope thereof in matters of health, education, protection against social vulnerabilities, social security, culture, respect for their essential dignity, freedoms and administration of justice.
Whereas it is known that the spaces, buildings, furnishings and installations of public, community and private educational centers in urban and rural areas reflect in their series of deficiencies that strongly limit the comprehensive formative function of children and in many cases, rather constitute risk factors.
Whereas the Constitution of the Republic determines in its Article 205 National Congress 1), that it corresponds to the National Congress, to create, decree, reform, repeal and interpret laws.
