Summary
This law creates and regulates two independent electoral institutions: the National Electoral Council, responsible for organizing and administering elections, primaries, and citizen consultations; and the Electoral Justice Court, which resolves electoral disputes. Both institutions operate independently from other branches of government and ensure that elections are secure, transparent, and trustworthy for all Honduran citizens.
Considerations
Whereas, in accordance with Article 1 of the Constitution of the Republic of Honduras, it is a State of Law, sovereign, constituted as a free, democratic and independent Republic to ensure to its inhabitants the enjoyment of justice, liberty, culture and economic and social well-being.
Whereas, democracy has a notable influence on the daily life of citizens and their material conditions of existence. Democracy is not only an ethical political system to which we must aspire in order to have a civilized society that can be considered as such.
Whereas, it is necessary to take measures for the implementation of an electoral model that generates confidence in the citizenry and provides security and certainty to political actors, allowing elections to become a stage of democratic construction and not of unpredictability and crisis.
Whereas, through Decree No. 200-2018, of January 24, 2019, this National Congress approved a reform to several articles of the Constitution of the Republic, aimed at strengthening electoral institutions, creating the National Electoral Council and the Electoral Justice Court, with the purpose of separating administrative, technical, logistical and jurisdictional functions. Said reforms were ratified on January 29 of the present year.
Whereas, it is necessary to create a Law so that the ad-hoc provisions for the selection and appointment of electoral authorities, powers (competencies) and prohibitions may be approved, which together determine the spirit and guidelines for action of the new electoral system proposed in the constitutional reform ratified in the year 2019.
Whereas, the Constitution of the Republic in its Article 205 Attribution 1) establishes that it is within the power of the National Congress: To create, decree, interpret, reform and repeal laws.
