This law creates a temporary Supervisory Commission (60 days) to oversee and reform the Public Prosecutor's Office. The Commission, elected by Congress, assumes the duties of the Attorney General, conducts employee evaluations, reorganizes internal structures, hires qualified personnel, and defines institutional policies to improve the agency's efficiency in prosecuting crimes.

Considerations

Whereas, as a result of the appearances of justice operators last week before the Full Chamber of the National Congress and before the Honduran people, we have all become aware that the fight against crime is not solely a matter for the National Police, but rather is a chain wherein after the police comes the Public Ministry in the Prosecution of Offenses, and concludes with the Judicial Branch which applies penalties in the specific cases that are brought to trial.

Whereas, the Full Chamber of the National Congress approved the Report on Justice Operators presented by the Special Commission on Security, and with respect to the Public Ministry, recommended to the Full Chamber its immediate Intervention through a special commission with the powers and competencies that the Law attributes to the Attorney General of the State.

Whereas, this National Congress is committed to providing security to the Honduran people insofar as it is competent in accordance with the Constitution of the Republic, and is motivated solely by the interest of saving human lives.

Whereas, it falls to the National Congress the faculty to create, enact, reform, interpret, and repeal the law.

Whereas, it corresponds to the President of the Republic, among other powers, to direct the general policy of the State, represent it, maintain the peace and interior security of the Republic, administer the public treasury, and enact extraordinary measures in economic and financial matters when the national interest so requires.

Whereas, the President of the Republic holds supreme direction and coordination of the centralized and decentralized Public Administration, the General Administration of the State, and therefore directs the economic and financial policy thereof, being able to act by himself or in Council of Ministers.

Whereas, the National Council of Defense and Security has adopted the necessary decisions to strengthen citizen security efforts within the Constitution and the laws, having defined a Shared Vision and Common Objectives that constitute the policy of comprehensive citizen security.

Whereas, the policy of comprehensive citizen security requires adequate planning and strategic execution by all Organs of the State that participate in its formation, coordination and execution, and must be properly coordinated at the highest level of the State.
