This law regulates the cremation of cadavers in Honduras, allowing it when the person requests it in their will, family members authorize it, or in cases of epidemics and contagious diseases. It establishes that only authorized crematoriums can perform cremations, municipalities must approve each case, and sets fines for those who operate without permits or fail to comply with legal requirements.

Considerations

Whereas the human person is the supreme purpose of the State and of society, not only in his or her physical condition, but also in his or her spiritual condition, which should even extend to his or her family, in cases such as death, with respect to mourning, culture, religion, and his or her last will.

Whereas Article 211 of Decree No. 65-91 dated May 28, 1991, containing the Health Code, authorizes the Ministry of State in the Office of Health to authorize the cremation of cadavers and human remains in Honduras for epidemics, without regulating any other case. Nevertheless, in developed countries the right to dispose of one's mortal remains during life is respected in accordance with one's last will, belief or culture, or failing that, their close relatives may do so, as well as other cases of utility and public health by the Health Authority.

Whereas it is the competence of the National Congress to create, decree, interpret, reform, and repeal laws.
