This law creates special contributions (taxes) for 5 years to finance security and crime-fighting in Honduras. It affects banks, telephone companies, mining, and international franchise restaurants, which must pay percentages of their income. Funds are managed through a trust with oversight from government, business leaders, and civil society to ensure transparent use for public safety.

Considerations

Whereas the Constitution of the Republic in its Article 61 guarantees to Hondurans and foreign residents in the country, the right to the inviolability of life, security, individual peace, freedom, equality before the law and property. Additionally, Article 60 of our Magna Carta establishes that the human person is the supreme end of society and the State. Everyone has the obligation to respect their property.

Whereas the Constitution of the Republic in its Article 328 establishes that the Economic System of Honduras is founded on the principles of: efficiency in production and social justice, distribution of wealth and national income, as well as the harmonious coexistence of the factors of production that make possible the significance of labor as the principal source of wealth and as a means of realization of the human person.

Whereas the Constitution of the Republic establishes the responsibility of the State of Honduras to guarantee through the institutions that comprise the Security and Justice sector, the preservation of public order, the prevention and combat of crime; the security of persons and their property; the execution of resolutions and sentences that contain dispositions or orders under the principles of legality and due process and strict respect for Human Rights.

Whereas the disproportionality of economic resources between common and organized crime, and the institutions of the Security and Justice sector makes it imperative the urgent need to expand the budgetary provisions of the entities responsible for the prevention and combat of crime.

Whereas the responsibility of the State of Honduras is articulated with the social commitment of the strategic actors of Honduran society, in a joint effort for the construction of a greater country in accordance with what is established in the Vision of Country - Plan of Nation.

Whereas in accordance with the Transitional Article of Decree 131 of the Tax Reform Law dated January 11, 1982, of the Constituent National Assembly that contains the Constitution of the Republic, it is the attribution of the National Congress to create, decree, interpret, reform and repeal the laws.
