This law establishes a retirement and pension system for judges, magistrates, and Judiciary employees who cannot join the Executive Branch's retirement program. It guarantees that after 10 years of service and age 58, they receive a monthly pension equivalent to 80-90% of their salary, and provides death, disability, and illness benefits. It is funded through 7% deductions from workers and contributions from the Supreme Court.

Considerations

Whereas, under article 4 of the Law on Retirements and Pensions of Employees and Officials of the Executive Branch, the Magistrates, Judges, Officials and Employees of the Judicial Branch were incorporated as of January 1, 1995, into the Retirement and Pension System of Employees of the Executive Branch.

Whereas, several of the Magistrates, Judges, Officials and Employees of the Judicial Branch, for reasons of age, length of service and service modality, were unable to affiliate with the Institute of Retirements and Pensions of Employees and Officials of the Executive Branch.

Whereas, personnel retired under the Law on Retirements for the Judicial Branch continue to enjoy the rights acquired under said Law, contained in Decree No. 114 of the National Congress dated March 5, 1954.

Whereas, the Law on Retirements for the Judicial Branch has fallen into decline and social injustice in relation to the benefits and services granted by other Social Security systems for the protected subjects.

Whereas, it is the responsibility of the State of Honduras to establish equality of conditions and benefits for Employees and Officials who perform their duties under identical service conditions, without privileges or discrimination for anyone.
