This law creates an Early Warning System run by a committee of three financial institutions (Central Bank, Banking and Insurance Commission, and Deposit Insurance Fund) that meet regularly to detect problems in the financial system. The goal is to prevent financial crises by monitoring risk indicators and coordinating actions to protect the country's economic stability.

Considerations

Whereas by constitutional provision, the President of the Republic has the general administration of the State and is responsible for exercising the supervision and control of banking, insurance, and financial institutions through the National Commission of Banks and Insurance. And whereas through the Central Bank of Honduras, the State manages the formulation and development of the country's monetary, exchange, and credit policy and promotes the normal functioning of the payment system.

Whereas to strengthen the safety net of the country's financial system, comprised of the Central Bank of Honduras as lender of last resort; the National Commission of Banks and Insurance as the supervisory entity of the financial system; and the Deposit Insurance Fund as the insuring entity of deposits made by the public in the national financial system, it is necessary to strengthen the coordination bodies where the three institutions participate and establish agreements, forms of collaboration, and actions that lead to minimizing the risks associated with the functioning of the financial system.

Whereas international experience has demonstrated that the prevention of crises in the financial system is substantially improved with the creation of Early Warning Systems that allow for timely guidance of prudential actions and monetary policy toward preventive action, to protect the country's macroeconomic stability.

Whereas it is necessary to reform Executive Decree Number PCM-38-2006 dated September 13, 2006, published in the Official Gazette "La Gaceta" on October 30, 2006, for the purpose of improving the functioning of the various components of the Financial Safety Net, which will contribute to the stability of the Financial System.
