Summary
This decree creates SISOCS, a digital system that requires public infrastructure institutions to publish information about public works and contracts openly and transparently on the internet, allowing citizens to freely access data about planning, execution, and costs of public projects, thus complying with international transparency standards.
Considerations
Whereas the Government of the Republic advances toward the achievement of the objectives and goals outlined in its Government Plan, which provide, among others, the establishment of a modern, transparent, responsible, efficient and competitive State; promoting the implementation of public management mechanisms based on the principle of publicity of its processes and actions and access by citizens to said information, through the use of electronic means, with the purpose of ensuring greater efficiency and effectiveness of public investment and spending, fostering citizen confidence in governmental functions and generating a culture of transparency and accountability. WHEREAS all public institutions and private parties are obliged to govern their public works contracting, supply of goods and services and consulting contracts relationships, by the principles of efficiency, publicity and transparency and equality and free competition, when they participate in bidding processes, contracting, concessions, sales, auctions of works or competitions; as well as to comply with the contracting conditions, use of formats of tender documents and terms of reference established in the State Contracting Law and its Regulations. WHEREAS to achieve equity in competition for contracts and significantly increase the flow of direct foreign investment and cooperation for the development of the country's productive infrastructure sector, it is necessary to modernize the information system on contracting and monitoring of works and supervision contracts managed by the Secretariat of Infrastructure and Public Services, through the General Directorate of Highways, the Road Fund and other entities that make up the Productive Infrastructure Cabinet strengthening institutional capacities for compliance with the State Contracting Law and the Law on Transparency and Access to Public Information. WHEREAS on July 14, 2014 Honduras was admitted, after a process of voluntary application, in the Construction Sector Transparency Initiative (CoST by its English acronym), which requires information management tools to comply with the public infrastructure data standard and subsequent assurance processes. WHEREAS the CoST Initiative is framed within the principles and values of Open Government and that monitoring the implementation and results thereof is part of the Collaboration Agreement and Good Faith for the Promotion of Transparency, Combating Corruption and Strengthening of Integrity Systems, signed on October 6, 2014 between the Government of the Republic of Honduras and Transparency International (TI).

Créase el Sistema de Información y Seguimiento de Obras y Contratos de S u p e r v i s i ó n ( S I S O C S ) , como un subsistema del Sistema de Contratación y Adquisiciones del Estado, HonduCompras, que operará en la Secretaría de Infraestructura y Servicios P ú b l i c o s ( I N S E P ) respecto a los proyectos de infraestructura pública de la red vial oficial y de los proyectos de las demás instituciones del Gabinete de Infraestructura Productiva. Dicho subsistema será absorbido por el nuevo sistema de compras de Honduras, que fortalecerá la sistematización y facilitará la divulgación abierta de información pública de manera proactiva y estará vinculado al Sistema Integrado de A d m i n i s t r a c i ó n Financiera (SIAFI).
El SISOCS será de uso obligatorio inicialmente para la Dirección General de Carreteras, unidades ejecutoras externas, Fondo Vial y las unidades ejecutoras de las demás instituciones del Gabinete d< Infraestructura Productiva, lo que c o n t r i b u i r á a! ordenamiento interno y divulgación de la información 3 documentación relevante a la planificación, contratación ejecución y seguimiento de obras y contratos de supervisiór de proyectos de obra pública con un enfoque de datos abiertos. Posteriormente será de uso obligatorio para el reste de las instituciones que contratan obras públicas y servicios de supervisión, de acuerdo con lo que establezca el Grupc Multisectorial del CoSt en Honduras, en coordinación cor la Oficina Normativa de Contrataciones y Adquisiciones del Estado ( O N C A E ) , adscrita a la S e c r e t a r í a de Coordinación General de Gobierno, como órgano rectoi de las compras del Estado y la Secretaría de Infraestructura y Servicios Públicos, como órgano rector del proceso de obra pública.
A efecto de una correcta interpretación y aplicación del presente Decreto Ejecutivo se entenderá por 1) Datos Abiertos: datos que pueden ser utilizados reutilizados y redistribuidos libremente por cualquie persona, e incluso integrados con otros conjuntos de datos, sujetos sólo a que se atribuyan a la fuente y a que se compartan de la misma manera en que aparecen publicados. 2) Divulgación Proactiva: poner a disposición pública en el momento que se ejecuta una acción, antes de que se formule una petición o solicitud de acceso a la información. 3) Estándar de Datos de Infraestructura Pública: serie de indicadores aprobados por la Junta Directiva a nive internacional de la Iniciativa de Transparencia en e Sector de la Construcción (CoST por sus siglas en inglés) para la divulgación de información en los paíse que se han adherido a la Iniciativa. 4) Registros de Información: medios utilizados para la divulgación y archivo de información.. 5) Proceso de Aseguramiento: evaluación sobre l integridad y exactitud de la información divulgada sobre las características generales de desempeño d las entidades que divulgan información bajo lo Estándares de CoST Internacional.
Mediante el SISOCS, la Dirección Genera de Carreteras, las unidades ejecutoras externas, el Fond Vial y las unidades ejecutoras de las demás institucione del Gabinete de Infraestructura Productiva, deberá A. 3 La Gaceta divulgar proactivamente toda la información referida a los indicadores contenidos en el Estándar de Datos de Infraestructura Pública de la Iniciativa de Transparencia en el Sector de la Construcción (CoST), la cual actualizarán permanentemente, conforme al contenido y procedimientos descritos en el correspondiente Reglamento Operativo del SISOCS.
El Grupo Multisectorial (GMS) de la Iniciativa CoST realizará el monitoreo a la Dirección General de Carreteras, las unidades ejecutoras externas, el Fondo Vial y las unidades ejecutoras de las demás instituciones del Gabinete de Infraestructura Productiva para verificar el cumplimiento de los estándares de divulgación de información, mediante procesos de aseguramiento, sin perjuicio de las facultades legales que le corresponden al Tribunal Superior de Cuentas y al Instituto de Acceso a la Información Pública.
La Oficina Normativa de Compras y Adquisiciones del Estado (ONCAE), dependiente de la S e c r e t a r í a de C o o r d i n a c i ó n General de Gobierno, Dirección Presidencial de Transparencia y Modernización del Estado, coordinará estrechamente con la Secretaría de Infraestructura y Servicios Públicos (INSEP) y las demás entidades del Gabinete de Infraestructura Productiva a fin de vincular el SISOCS al sistema HonduCompras, con el propósito de endentar los registros de información y evitar duplicidad de depósitos de información pública.
El presente Decreto Ejecutivo entra en vigor después de su publicación en el Diario Oficial "La Gaceta". Dado en la ciudad de Tegucigalpa, municipio del Distrito Central, a los veinticuatro (24) días del mes de enero del año dos m i l quince (2015).
