This regulation establishes how Honduras' Security Ministry and National Police operate. It aims to ensure these institutions function in an orderly, transparent, and effective manner in crime prevention and citizen protection.
Considerations
Whereas through Decree 018-2017, published in the Official Gazette La Gaceta 34,463 of October 10, 2017, the Organic Law of the SECRETARIAT of State in the Department of Security and of the NATIONAL POLICE was enacted, thus repealing Legislative Decree No. 67-2008, published in La Gaceta on October 31, 2008 and its amendments.
Whereas the Organic Law of the SECRETARIAT of State in the Department of Security and of the NATIONAL POLICE, in its article 125, concerning Regulations, establishes that "The Special Commission for the process of Purification and Transformation of the NATIONAL POLICE must prepare the regulations of this Law, which shall be approved by the SECRETARIAT; all of the foregoing must be carried out during the 'vacatio legis' of this Law. Likewise they are authorized for the issuance of Complementary Regulations, Manuals, Guides, Directives and Instructions of a transitory or permanent nature".
Whereas article 4 of the Organic Law of the SECRETARIAT of State in the Department of Security and of the NATIONAL POLICE indicates, among other things, that the SECRETARIAT has the structure with the departments established in the Organic Law and its Regulations.
Whereas article 29 of the Organic Law of the SECRETARIAT of State in the Department of Security and of the NATIONAL POLICE also provides that the officials and employees of the SECRETARIAT are part of a special regime established by this Law and its regulations, for which reason it is necessary to establish through this regulation, guiding norms that allow the development of said special regime.
Whereas through this General Regulation it is intended to regulate the provisions of the Organic Law of the Secretariat of State in the Department of Security and of the National Police, with regard to its organization, direction, coordination and operation; and in this way ensure that this legislative instrument becomes operational and fulfills the fundamental purpose of governing the real aspects on which it is intended to have an impact; given that a norm without its proper and timely regulation would be prevented from achieving its objective. Being so and with the commitment to have an impact on the Institutional Strengthening process that is being advanced, it is essential to establish the norms that in a clear and precise manner allow the implementation of the changes and new organization of the police structure.
