Considerations
Whereas, in accordance with Article 195 of the Tax Code, Decree No. 170-2016, the Customs Administration was created as a decentralized entity of the Office of the President of the Republic, with functional, technical, administrative, and national security autonomy, with its own legal personality, responsible for the control, verification, oversight, and collection of customs taxes, with authority and jurisdiction at the national level and domiciled in the capital of the Republic.
Whereas, by means of Executive Decree PCM-059-2019 of the twenty-seventh (27) of September of the year two thousand nineteen (2019), published in the Official Gazette La Gaceta on the thirtieth (30) of September of the year two thousand nineteen (2019), the Constitutional President in Council of State Secretaries shall suppress and liquidate no later than the thirty-first (31) of December of two thousand nineteen (2019) the Deputy Directorate of Customs Revenue (DARA).
Whereas, by means of Executive Decree PCM-059-2019 aforementioned, the new Customs Administration is institutionalized within the framework of what is prescribed in the Tax Code, whose name shall be Customs Administration of Honduras, and consequently, it assumes the attributions and powers granted to the Presidential Commission for Comprehensive Reform of the Customs System and Foreign Trade Operators (COPRISAO) as of the first (1) of January of two thousand twenty (2020).
Whereas, in accordance with Decree 170-2016, the Executive Director of the Customs Administration of Honduras has authorizing, directing, administrative, and supervisory powers over the Customs Service.
Whereas, the Executive Director has full power to administer the customs system, exercising all the attributions and powers established in the Tax Code, the Central American Uniform Customs Code (CAUCA) and its Regulations, and laws and regulations related to customs and tax matters as appropriate.
Whereas, the current international commerce processes in which the country participates through Agreements, Treaties, and Unions require a modern, agile, technologically advanced customs authority, with simple and expeditious schemes and procedures to be able to efficiently serve foreign trade operators.
Whereas, the acts of the organs of the Public Administration shall adopt the form of Decrees, Agreements, Resolutions, or Administrative Orders.
