Summary
This decree reforms the Special Law on Intervention of Private Communications, requiring judges to send an official request to the Communications Intervention Unit to authorize the interception of calls or messages in criminal investigations. It affects judicial authorities and crime-fighting agencies, allowing them to obtain evidence through monitored communications under legal supervision.
Considerations
That Article 5 of the Constitution of the Republic was reformed on January 13, 2011 through Decree No. 275-2010 dated and constitutionally ratified on February 17, 2011, through Decree No. 3-2011, which strengthens democracy and direct political participation of the people through the mechanisms of Referendum, Plebiscite, and Citizen Law Initiative.
That Constitutional Article 5 orders the issuance of a special law that develops the forms of citizen participation in matters of national, regional, subregional, departmental, and municipal interest, for the practice and implementation of citizen consultations.
That the decision of the sovereign people expressed through the mechanisms of Referendum and Plebiscite is the most direct form of expression of the will of the people on one or more specific matters submitted to their consideration, whose mandate must be put into effect and executed without more formalities than those strictly necessary for its better fulfillment, and therefore the formalities to which the National Congress, Executive Branch, and Judicial Branch, as constituted Powers, are subject are not applicable in these cases, such as the ratification of a constitutional norm.
Amendments
- Modifies: Special Law on the Interception of Private Communications (Amendment) — articles 24
