This agreement establishes the procedures and requirements that citizens of countries classified in category B must meet to obtain a consular visa in Honduras. It defines the responsibilities of the Ministry of Foreign Affairs (which issues visas) and the National Migration Institute (which provides support), facilitating visa processing for tourism, business, investment, and family reunification.

Considerations

Whereas, in accordance with Article 71 of the Migration and Foreigners Law, the consular visa shall be issued by the Diplomatic and Consular Representations of Honduras to foreigners, in accordance with the provisions issued by the Secretary of State in the Offices of Foreign Relations and International Cooperation, with prior agreement with the Secretary of State in the Offices of Human Rights, Justice, Governance and Decentralization.

Whereas, with the objective of promoting tourism, commerce, foreign investment, technicians and skilled labor, family reunification and other matters of national interest, the Government of the Republic of Honduras, through Agreement No. 001/DGAC/2010, dated August 19, 2010, approved the change of Visa Category for the Republics of People's China, Haiti, Albania and Bosnia Herzegovina, from Category "C" to Category "B"; and India and the Russian Federation, from Category "B" to Category "A".

Whereas, the Secretary of State in the Offices of Foreign Relations and International Cooperation, under Agreement No. 001/DGAC/2010, dated August 19, 2010, issued Circular No. 953-DGAC-2010 dated August 19 of the same year, containing the procedures for the management and issuance of consular visas for nationals of the Republics of People's China, Haiti, Albania and Bosnia Herzegovina, holders of ordinary or regular passports and subsequently, through Circular No. 046-DGAC-2011 dated November 9, 2011, approved the modification of the visa category from exempt to consular visa for nationals of India.

Whereas, the migration facilitation policies linked to the integration of Central America were promoted at that time by the Heads of State and Government of the Republics of El Salvador, Guatemala, Honduras and Nicaragua, becoming the genesis of the CA4 Agreements for the mobilization of nationals of the States Party and extra-regional foreigners who circulate through said territories, under a standardized migratory treatment.

Whereas, the issuance of Consular Visas for entry into the national territory corresponds to the Diplomatic or Consular Representations of Honduras abroad authorized for such purpose, in accordance with the provisions issued by the Secretary of Foreign Relations and International Cooperation.

Whereas, it is necessary to define the procedures for the issuance of consular visas for nationals of the aforementioned countries and all those classified in Category "B", and to establish criteria and cooperation actions between the authorities of the National Immigration Institute and the authorities of the Secretary of Foreign Relations and International Cooperation, ensuring that citizens of countries requiring a consular visa comply with the legal requirements for obtaining the corresponding visa, entry and permanence in the national territory.

Whereas, through Executive Agreement No. 21-2016 dated March 3, 2016, citizen HÉCTOR LEONEL AYALA was appointed as Secretary of State in the Offices of Human Rights, Justice, Governance and Decentralization. Likewise, through Agreement No. 459 SRH-2016 dated July 18, 2016, citizen María Andrea Matamoros Castillo was appointed as Secretary of State, by Law in the Offices of Foreign Relations and International Cooperation. Using the powers established in Articles 246, 247 and 255 of the Constitution of the Republic; 1, 7, 8, 29 as amended, 36 numerals 1 and 6, 45, 116, 118, 119 numeral 3 of the General Law of Public Administration; 1 and 5 of the Law of Administrative Simplification, 2 of Legislative Decree No. 253-2013; 22, 23, 24, 25, 26, 27, 63, 80, 81, 87 and 88 of the Administrative Procedure Law and 13 of Executive Decree PCM-001-2014.

Whereas, the DRINKING WATER AND SANITATION BOARD OF THE RINCÓN OCOTILLO COMMUNITY is created as a civil association of mutual benefit, whose statutory provisions do not contradict the laws of the country, public order, morality and good customs, therefore it is appropriate to grant what has been requested.

Whereas, the President of the Republic issued Executive Decree No. 002-2002 dated January 28, 2002, by which he delegates to the Secretary of State in the Offices of Governance and Justice, specific competence for the issuance of this administrative act in accordance with Articles 16, 119 and 122 of the General Law of Public Administration, 4 and 5 of the Administrative Procedure Law.

Whereas, through Executive Agreement No. 03-2014 dated January 24, 2014, citizen RIGOBERTO CHANG CASTILLO was appointed as Secretary of State in the Office of Human Rights, Justice, Governance and Decentralization, modified through Executive Agreement No. 03-A-2014 dated January 24, 2014.
