It specifically excludes aesthetic beauty services, prepared foods and certain rentals. It benefits users and professionals while ensuring they comply with documentation requirements.
Considerations
Whereas the Constitution of the Republic in Article 351 establishes that the tax system shall be governed by the principles of legality, proportionality, generality, and equity, in accordance with the economic capacity of the taxpayer.
Whereas Article 15 literal d) of the Sales Tax Law, contained in Decree No. 24 of December 20, 1963 and reformed by Decree No. 37-2017 published in the Official Gazette La Gaceta on November 14, 2017, establishes that the following services are exempt from the payment of Sales Tax: electrical energy; potable water and sewerage; construction services; rates and services provided by municipalities for the benefit of the community; professional fees obtained by natural persons; teaching services; hospitalization and ambulance transport services; clinical laboratory and human clinical analysis services; radiological services and other medical services, diagnostic and surgical services except for aesthetic beauty treatment services such as: spa, laser liposuction and similar services; land passenger transport; banking and financial services; except for the rental of movable property with purchase option; those related to life insurance premiums and reinsurance in general. Sales of prepared food for consumption within or outside the premises shall be subject to this tax.
Whereas Article 4 of Decree No. 290-2013 published in the Official Gazette La Gaceta on April 5, 2014, interprets Article 18 of Decree No. 278-2013 dated December 21, 2013, in the sense that all residential subscribers who have a monthly electrical energy consumption greater than seven hundred fifty kilowatts/hour (750kw/h) must pay the Sales Tax for the provision of public or private service. No type of residential user is exempt from such payment regardless of the use of the real property.
Whereas Article 5 of Decree No. 119-2016 published in the Official Gazette "La Gaceta" on August 25, 2016, orders the Secretary of State in the Department of Finance, in coordination with the Tax Administration, to prepare the corresponding technical tax and customs instructions for the application of Article 15 of the Sales Tax Law and its reforms, within sixty (60) business days following the date of publication of said Decree.
Whereas Article 3 of Agreement No. 288-2016 published in the Official Gazette "La Gaceta" containing the Regulation of the Fiscal Responsibility Law, establishes that tax exemptions are all those provisions approved by the National Congress and expressed in tax rules with the rank of Law that create taxes, which wholly or partially free the taxpayer from the payment of the tax obligation.
Whereas Article 18 Numeral 2 of the Tax Code establishes that tax exemption does not exempt, however, the taxpayer or responsible party from the duties of filing returns, withholding taxes, where applicable, declaring their domicile and other obligations contained in this Code.
Whereas in accordance with Numeral 15) of Article 29 of the Public Administration Law and its Reforms, the Secretary of State in the Department of Finance is responsible for everything concerning the formulation, coordination, execution, and evaluation of policies related to Public Finances.
