This agreement updates Honduras' invoicing rules to adapt them to modern commercial practices. It affects businesses, printing companies, and taxpayers by allowing alternative documents to support taxes and extending deadlines for meeting customs obligations, with the goal of simplifying tax procedures.

Considerations

Whereas Article 247 of the Constitution of the Republic establishes that the Secretaries of State are collaborators of the President of the Republic in the orientation, coordination, direction and supervision of the organs and entities of the national public administration, in the area of their competence.

Whereas the Constitution of the Republic in Article 351 establishes that the tax system shall be governed by the principles of legality, proportionality, generality and equity, in accordance with the economic capacity of the taxpayer.

Whereas the "Regulation of the Billing Regime, Other Fiscal Documents and Fiscal Register of Printing Facilities" contained in Agreement No. 481-2017 published in the Official Journal La Gaceta dated August 10, 2017 and its amendments contained in Agreement No. 609-2017 published in the Official Journal La Gaceta dated October 2, 2017, must be adjusted in accordance with economic activity and commercial customs.

Whereas on June 17, 2017, Agreement No. 262-2017 was published in the Official Journal La Gaceta containing the "Tax and Customs Instructive for the Application of Article 15 Subsections f) and g) of the Sales Tax Law and its amendments."

Whereas Article 6 of the Sales Tax Law and its amendments provides that the credit or refund of Sales Tax paid on inputs and services incorporated or used in the production of exported goods is applicable when the producer is the same exporter. WHEREAS the Regulation of Customs Procedure for Reexportation of Merchandise under the Temporary Import Regime contained in Agreement No. 704-2017, published in the Official Journal La Gaceta dated December 28, 2017, in the second paragraph of Article 8, establishes that "The goods and inputs necessary for the production of the merchandise described therein must be discharged semiannually by means of a Single Customs Declaration no later than January thirty-first (31) and July thirty-first (31) of each year, ordering that the first discharge of goods and inputs must be carried out no later than July thirty-first (31) of two thousand eighteen (2018)."

Whereas by virtue of the fact that for the implementation of said operation the issuance of the procedure and technological application to be used in said discharge has been an indispensable requirement, which is in the process of being concluded for the corresponding socialization and training; consequently the time period established in the preceding recital is impossible to comply with both for the Customs Administration and for the Tax Obligors.

Whereas it is necessary to extend the time period established in Article 8 of Agreement 704-2017 for the first discharge of goods and inputs in order to socialize with the Tax Obligors the technological application procedure to be used in said discharge of goods, which will facilitate compliance with said obligation.

Whereas it is necessary to apply measures for the purpose of administrative simplification with the objective of ensuring adequate administration and efficiency in the processes concerning tax and customs procedures.

Whereas in accordance with Numeral 15) of Article 29 of the Public Administration Law and its Amendments, the Secretariat of State in the Office of Finance is responsible for everything concerning the formulation, coordination, execution and evaluation of policies related to Public Finances, whereby it must ensure the correct application of the legal norms related to the functioning of the Tax System of Honduras.

Whereas in accordance with Article 60 of the Regulation of Organization, Functioning and Competence of the Executive Branch contained in Executive Decree PCM-008-97 amended by Decree PCM-35-2015 published in the Official Journal La Gaceta on June 26, 2015, it is the responsibility of the Secretariat of State in the Office of Finance through the General Directorate of Tax Policy to define, monitor and evaluate tax policy, in order to achieve a sustainable fiscal policy for the benefit of Honduran society.

Whereas in accordance with Article 195 Numeral 3 of the Tax Code the mission of the Tax Administration and the Customs Administration must be oriented to optimize collection through the administration, application, inspection, supervision, review, efficient and effective control, and execution of collection of internal and customs taxes, as applicable.

Whereas Article 36 numeral 8 of the General Law of Public Administration establishes that Attributions of the Secretariats of State include issuing Agreements and Resolutions on matters within their competence and those delegated to them by the President of the Republic and ensuring their execution.
