This decree approves electoral reforms that split the Supreme Electoral Court into two institutions: the National Electoral Council (administrative and technical functions) and the Electoral Justice Court (judicial decisions). It affects all citizens by changing how elections are organized and overseen, aiming for greater efficiency and confidence in electoral processes.

Considerations

Whereas, in accordance with Article 1 of the Constitution of the Republic, Honduras is a Rule of Law State, Sovereign, constituted as a free, democratic and independent Republic to ensure its inhabitants the enjoyment of justice, liberty, culture and economic and social well-being.

Whereas, democracy notably influences the daily life of citizens and their material conditions of existence. Democracy is not only a political-ethical system to which we should aspire in order to have a civilized society that can be considered as such.

Whereas, it is necessary to take measures for the implementation of an electoral model that generates confidence in the citizenry and provides security and certainty to political actors, allowing elections to become a stage of democratic construction and not of unpredictability and crisis. For such purpose, it is necessary to effect a separation of administrative, technical and logistical functions, on the one hand, and jurisdictional functions on the other, in two (2) distinct entities: the National Electoral Council and the Electoral Justice Court. Both institutions assume the totality of the tasks heretofore executed by the Supreme Electoral Court, in addition to some supplementary ones to strengthen the new institutional model.

Whereas, taking into account that the model of a divided electoral body ensures more efficient functioning of technical-administrative tasks and a more timely and definitive application of electoral justice, overcoming the limitations that have been identified in recent electoral processes, its implementation in our country would serve to strengthen democracy and the administration of justice.

Whereas, in accordance with the provisions of Article 205, Attribution 1 of the Constitution of the Republic, it is within the power of the National Congress to: create, decree, interpret, reform and repeal laws.

CONSIDERING: That democracy notably influences the daily life of citizens, in their material conditions of existence. Democracy is not only a political-ethical system to which we should aspire to have a civilized society that can be considered as such. CONSIDERING: That it is necessary to take measures for the implementation of an electoral model that generates confidence in citizens and grants security and certainty to political actors, allowing elections to become a stage of democratic construction and not of unpredictability and crisis. For this purpose, it is necessary to perform a separation of administrative, technical and logistical functions, on one hand, and jurisdictional functions on the other, in two (2) distinct entities: the National Electoral Council and the Electoral Justice Tribunal.
