This decree reforms the INJUPEMP Law to improve pensions for public employees. Considerations
Whereas the LAW OF THE INSTITUTE OF RETIREMENT AND PENSIONS OF EMPLOYEES AND OFFICIALS OF THE EXECUTIVE BRANCH (INJUPEMP), contained in Decree No. 357-2013 of January 20, 2014, published in the Official Gazette La Gaceta No. 33,398 of April 5, 2014.
Whereas the incorporation of the Secretary of State in the Office of Economic Development is very important for the fulfillment of the institutional objectives of the Institute of Retirement and Pensions of Employees and Officials of the Executive Branch (INJUPEMP), as a collaborating entity within various divisions to ensure the continuity of pension payments and contribute to the economic development of the country within the framework of State policies. Likewise, and considering the affinity in institutional objectives shared by the Secretary of State in the Office of Labor and all provisions of the LAW OF THE INSTITUTE OF RETIREMENT AND PENSIONS OF EMPLOYEES AND OFFICIALS OF THE EXECUTIVE BRANCH (INJUPEMP), contained in Decree No. 357-2013 of January 20, 2014, which shall be read as follows:
Whereas the retirees of the Institute of Retirement and Pensions of Employees and Officials of the Executive Branch (INJUPEMP) are obligated to suspend the payment of their retirement benefits when working in the public service, and are not permitted to contribute to the Institute, and for this reason are not allowed to adjust their pension once the suspension is concluded.
Whereas the Law protects the granting of disability benefits by subjecting it to a specialized procedure, and yet Article 59, numeral 4), establishes an age limitation that is not appropriate to be established in the Law.
Whereas the Law of the Institute of Retirement and Pensions of Employees and Officials of the Executive Branch (INJUPEMP) requires reforms to correct unforeseen situations therein and in pursuit of the social protection and welfare of system participants, as well as of retirees, pensioners, and their dependents.

In the aforementioned Decree-Law, the Trust Agreement subscribed between the Institute of Property (IP), the Commission for the Promotion of Public-Private Partnership (COALIANZA) and Banco Atlántida, S.A., as Trustee, was approved for the Project of the Property Administration System of the Republic of Honduras. Within said trust agreement it was defined, as its background and scope, that with the rate of the Institute of Property (IP), a property administration system shall be operated and maintained that includes the services of Real Property Registry, Commercial Registry, Intellectual Property Registry, Special Registries and others that the IP created or incorporated. Real Property Cadastre and Notarial Protocol.
Whereas although there are two trust agreements for the Institute of Property (IP) in the same fiduciary bank, the vision of integral unity and unification of the registrable activities carried out by the Institute of Property (IP), its associated centers and other strategic allies, must prevail, and these must be carried out under a coordinated and coherent vision and criteria, in such a way that the existing trust agreements adhere to legal reality and in order to achieve that the Institute of Property (IP) must comply in accordance with the law.
Whereas within the functions of the Trustee, in both trust agreements, is that of bidding, selecting, awarding and contracting an operating administrator or, even, a non-profit institution for the execution of technical support, with the objective that it must provide the services of Real Property Registry, Commercial Registry, Intellectual Property Registry, Special Registries and others that the IP created or incorporated.
