This decree creates SENASA, an independent institution that protects animal and plant health, as well as food quality in Honduras. It controls agricultural imports and exports, issues health certificates, prevents pests and diseases, and represents the country before international agricultural trade organizations.

Considerations

That in accordance with Article 235 of the Constitution of the Republic, the President of the Republic exercises the powers of the Executive Branch in representation and for the benefit of the People.

That it is an attribution of the President of the Republic to direct the economic and financial policy of the State, to create and maintain public services and to take necessary measures for their proper functioning.

That in accordance with Article 11 of the General Law of Public Administration, the President of the Republic is in charge of the supreme direction and coordination of the Centralized and Decentralized Public Administration, and may in the exercise of his functions, act by himself or in Council of Ministers.

That according to Article 3, first paragraph of the General Law of Public Administration, as amended by Legislative Decree No. 266-2013, it states that "The creation, modification or suppression of the organs of Public Administration, including the Deconcentrated ones and the Decentralized Institutions, can only be done after prior definition of the public purpose to be satisfied when its economic-administrative feasibility is proven, considering the cost of its operation, specialized performance or the anticipated savings."

That Article 4 of the General Law of Public Administration, as amended by Legislative Decree No. 266-2013, establishes "The creation, modification, or suspension of the Secretariats of State or of the Deconcentrated Agencies or Entities, can only be done by the President of the Republic in Council of State Secretaries".

That the trends of the National Agricultural and Livestock Health Organizations are directed towards the Deconcentration of their organizational structures, greater participation of the private sector, administrative simplification and the agility of the sanitary services they provide.

That to guarantee a more efficient and effective operation of the Sanitary, Phytosanitary and Agro-food Safety Services, the studies carried out in this regard reveal that it is necessary to maintain the institutional status of the entity as a Deconcentrated Organism dependent on the Secretary of Agriculture and Livestock.
