This decree creates the Presidential Office of Foreign Trade (OPCE), a new institution directly under the President, responsible for formulating and managing Honduras' trade policy. It transfers foreign trade functions from the Ministry of Economic Development to this new office to centralize and strengthen the management of trade agreements, international negotiations, and export promotion.

Considerations

Whereas Articles 245, numerals 2), 11), 30) and 45) of the Constitution of the Republic establish as attributions of the President of the Republic, to direct the general policy of the State and represent it, to issue, among others, decrees and agreements in accordance with law, to direct the economic and financial policy of the State and the other attributions conferred upon him by the Constitution and the laws, respectively.

Whereas the international environment warrants having an institutional framework that allows prioritizing foreign trade actions or policies, in such a way that they respond to the objectives and priorities of the country and the Government of the Republic, that contribute to maintaining Honduras' competitiveness and positioning in external markets and specifically in our export sector.

Whereas the value of exports with respect to Gross Domestic Product (GDP) represents approximately 43% on average over the last fifteen (15) years, and the index of commercial openness is approximately 106% during the same period; which makes the external sector a strategic and priority axis of economic activity; the attraction of investments, job creation, income generation for Hondurans; and the collection of taxes on foreign trade, which translates into sustained economic growth that contributes to poverty reduction.

Whereas Article 12 of the General Law of Public Administration as amended by Decree No. 266-2013 of the sixteenth (16) of December 2013 and published in the Official Gazette "La Gaceta" on the twenty-third (23) of January 2014, containing the Law to Optimize Public Administration, Improve Services to Citizens and Strengthen Transparency in Government, establishes that the President of the Republic has the power to organize his cabinet and grant the rank of Secretary of State.

Whereas Article 22 of the General Law of Public Administration establishes that the Council of Secretaries of State has among its attributions the power to create, modify, merge, separate or suppress dependencies of the Public Administration.
